Court Records For K1 Visa in Jamaica

Hello,

I was wondering in the K1 packet 3 it mentions the beneficiary will need Court Records if have been convicted of a crime or other offense, obtain a certified court record covering the offense. Is this required if the beneficiary had to go to court for Driving with no insurance? Is that considered an offense or is the Embassy just meaning for criminal offenses? Please advise.

Get the Court Records. I don't know what the severity is in Jamaica, but driving with no insurance is (usually) a criminal offense in the U.S. Even if you don't need it now, it may come up down the line during an interview. Better to get it now and have it just in case then to be trying to get them later on.

it is a criminal offence but as far as i know it is not something that you have to declare as it will not show up in any checks. that is definitely true for the UK anyway. having the court record cant hurt though

Thanks all. We will get the court record just in case. Can never have too much info. Our luck they will ask for it. They seem to be asking for everything under the sun for us with his Birth certificate issue/late registration with RGD anyway.

it is a criminal offence but as far as i know it is not something that you have to declare as it will not show up in any checks. that is definitely true for the UK anyway. having the court record cant hurt though

after looking in to this i could be wrong and maybe it is best that you declare it and obtain court records just to be safe

Dan, What do you mean by declare it and where and what form would we do this on? We already have an approved 1-129F petition. This was just brought to my attention when we were reading over packet 3 and it mentioned court records and then that is when he told me he went about court for No insurance. It definatley will not be an issue in the US as I am an insurance agent! somewhat ironic, but I'm sure money was the reason.

Have you seen his PC yet? What's listed on it?

No have not seen it yet, because unfortunately he can't get it without his passport. Can't renew his passport until his late registration is coplete which should hopefully soon be done. Long story. Birth cert issues found when he went to renew his passport 11 months ago. It has been a nightmare that still is not fixed. Fun times with RGD let me tell you.

i thought maybe there was a form in packet 3 that you could declare it on but if not then it doesnt matter.

i have the same problem with driving without insurance and i didnt declare it on the I-129F either because i didnt think it mattered but after reading up on it i realise maybe i should of declared it. what im going to do is get my police certificate and see what that says and get my court record just in case i need it. if the offence shows up on my PC then when i go for interview i will tell them straight away that i made a mistake rather than letting them find out for themselves but if it doesnt show up on my PC then i wont declare it. i know it wont be an issue in the US but honesty is the best policy

Gotcha! Thanks. This whole thing is so nerve wracking. We will get the darn Court record just to be on the safe side before we even see what if anything shows up on police cert. Just another thing to spend some money on I guess!

If it is on the PC and you did not declare it, then you have an issue of having committed fraud and lying to the government - which I know sounds way bizarre, but believe me, it is enough to find you ineligible - I have a friend that got denied his GC and deported because of this happening - something he thought was minor and not a criminal charge was on his police report.

Make sure you see the report BEFORE you go to the embassy, and that the insurance charge is all it is listed as - you never know what gets listed with the JA police.

traffic offences are not recorded as criminal records in jamaica

They will show up on your court record - there was someone whose visa was approved, pending him resolving his outstanding tickets.
