Hello Everyone,

My story is little Complex here.

I have been in US Since 2007 Entered as J2(spouse Visa). Then Got my Own J1 Visa worked as Manager for Hilton Hotel for 18 Months. My J1 Visa got expired and did AOS to H4( as my wife was on H1 by then).

I didn't wanted to stay dependent on her to again got my own F-1 ( student Visa , studied Master). Went to india for Visa stamping but got rejected as they told me I can study on h4. So again came back to US on H4 & again changed to F-1. Finally I am on my own Student Visa now.

During this phase of life I had couple up& down & my marriage didnt work out and started living separate since 2 years. Finally I filed for Divorce , hopefully I am will get it soon. while i was working at Hotel, i was separated from wife and I met USC girl.

My question is

1. If i get Divorcee in 1st week of Sep 2011, How soon I can get married to Gf ( USC)

2. She is single mom, never married with two kids. she is looking for new Job right now. Does she has to be working full time & how much she should be making, so that we can apply for my AOS for GC?

3. what kind of Document do I need from her Side to file for AOS for GC

4. Do i need lawyer in my case?

This is governed by the jurisdiction in which you intend to marry. Some states/counties require you to have been divorced for a certain period of time. You need to check with your local probate court.
