hi everyone,

i us citizen) want to apply for my sister, her husband and 3 kids. they are uk citizens.

what kind of papperwork do i need and what forms to fill out

only one 130, spouse and children under 21 are derivatives. it will take a very long time. more than 10 years.

Only the I-130 for the sister is needed. Once it has been approved, which will be about 5 months after it has been submitted, a priority date will be locked in. Currently they immigration folks work on petitions with a priority date of April 8, 2000 for the F4 category and Great Britain.

That means the sister and her husband can move to the U.S. about May 2023 (5 months + 11 years and 4 months).

If the child is still under the age of 21 by May 2023, she can also immigrate. If not she's considered old enough to live on her on in Merry Old England and can't ride piggyback on her mom's immigrant visa anymore.

No, that's only if you're petitioning for a spouse. Read the VJ guides and the I-130 form instructions.

Also, there seems to be some confusion about derivative visas and when a separate petition is required. Immediate relative visas (the ones that begin with "IR") do not allow for derivative visas - each person who will be applying for a visa needs a separate petition. Family preference visas (ones that begin with "F") allow spouses and minor unmarried children to receive derivative visas - only a petition for the primary beneficiary is required.

Siblings of a US citizen apply for an F4 family preference visa. Only one petition is required for the primary beneficiary. Spouses and unmarried minor children can apply for derivative visas.

05/01/2013 - Removal of Conditions - APPROVED!
