Hello,

I'm new to this forum and to this whole issue I'm trying to figure out.

I am a US citizen trying to bring my mother to US. My mother came to US in 2007 as a guest and overstayed her visa by roughly a year and a half. She was NOT deported.

I'm not even sure where to start..

Do I file I-130 and then, if approved, we can file I-601?

Is this correct?

If someone knows please help.

You file the I-130, and follow the path for her visa. She will be denied at her interview, and then you will submit the I-601.

did she return back to her country then no.

no, not true, you cannot file the i601 for parents, there is no forgiveness for overstay of parents. they will be banned for 10 year, there is no waiver available for parents.

now if she is still in the US, no waiver needed, overstay is forgiven if she entered legally.
