I am currently filling out my I-864 Affidavit of Support for my husband's immigrant visa. We are completing the immigrant process from the United Kingdom and my mother is going to be our joint sponsor so she is also filling out an I-864 from America. Because we are filling out separate forms, we obviously have two different household sizes (here it is just the two of us, but my mom's household size will be listed as 3 on her form.) My income is not sufficient to meet the poverty requirement on my form. My question is, will they examine both our I-864's together so they can see that with my mom's help we will meet the total requirement? And will they see our household size as 5 people even though it will only be 4 because my husband is counted twice, once on both of our forms since he is the intending immigrant?! I'm so panicked about this whole thing and just need some reassurance. I don't want them to think we're under the poverty limit when we're not. Thanks in advance to anyone who can help me out!

Your mother's I-864 will be considered separately from yours. Your own I-864 is necessary but as you do not meet the requirements the actual details of your income etc won't really be relevant. It is your mother's I-864 which will have to meet all the financial requirements. Her income must meet the requirements for her household size. She cannot combine her income with yours.

Yes, your mother I-864 is the relevant one but you still have to submit your I-864.

The total number of household on your mother's I-864 will have to be just 3 - In I-864 of your mother, item 10 will have your husband and item 21 will have the other two members of your mother-in-law (your mother-in-law and the other person). You will not be in your mother's I-864.

Your I-864 will have your husband in item 10 and just youself in item 21 (don't add your husband aagin in 21,c).

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.
