Hello

I received the NOA for the I-130, I-131, I-765 and I-485 on August 9th.

The next day, I get a rejection notice that goes like this:

Recently, you submitted an application for immigration benefits. That form was submitted with an extra remittance that is not required to process your application. Your check is being returned to you with this notice. No additional action by you is required at this time.

Please be sure to complete the application fully, submit the appropriate fees, and include all required supporting.

If you have any questions.........etc.

They sent back the check for the I-131, a green neon xerox that starts with: Dear applicant, when you resubmit please enclose this letter and a xerox of the package.

We called the 1-800 number and the person who answered thinks (yes, thinks) that they only rejected the fee on the I-131 and that we don't need to resend it. This person doesn't really know.

The notice is confusing, on one hand they say no further action required, and then they say resubmit.

So I was wondering, should we re send the I-131?

There's no check needed for the I-131 when you file the I-485 at the same time or already filed for the I-485.

ditto, there is no charge for the 131 when sent concurrently with the i485. the same for the 1864 and the 1765.

If they only sent the check, then here is nothing you need to do. If they also sent back the form, then resend the form without the check and with a copy of your NOA1 from I-485.

The sentence at the end is a reminder to read the instructions thoroughly in the future to avoid errors like this - it's not instructions to do it now. Good luck.

Yes, we decided to file for it at the last minute, so we did not read the instructions for paying that well.

They only sent the check back, so I guess it will go well.
