Hmmm... too many unknowns in this story. I'm not going to defend the boy, however, based on what school officials insisted and what their actions were has anyone considered the other side of the coin?

School officials "insisted that her story was made up and badgered her into recanting." Why would they do this? Perhaps so they wouldn't get any unwanted publicity and to push it under a rug. What if, the girl is the agressor. What if "she" forced, cooerced, or threatened the boy into having sex with her and then two years later claims she was raped? How would things be handled? School cover it up? Boy or boy's parents want it covered up? Why was she required to write a letter of apology? Things don't add up. It makes me wonder if she was the agressor. It certainly answers the question of why her parents would not completely be balking at the idea of her writing a letter of apology and then returning to that same school. For that to happen it almost makes it seem like she was the agressor and perhaps her family/parents have extremely good school ties so they let her back in.

Then it happened again? 2 years later? Ok, no boy is that foolish. I say she was the agressor, her parents have ties to the school, and she got away with raping the boy, coercing, or threating the boy into having sex with her... twice. Nothing else really makes a whole lot of sense given the facts in the article.

Is what I have stated above correct? Who knows, but it is certainly a point no one else has considered and it would certainly answer some of the questions on how in the world things transpired the way they did over the years.

A special ed girl in a Missouri middle school reported that she was raped a couple of years ago. But school officials insisted that her story was made up and badgered her into recanting:

the girl wrote an apology to the boy she accused of raping her and had to personally give it to him,

according to the lawsuit. She was then expelled for the remainder of the 2008-09 school year....The girl returned to the middle school for the 2009-10 school year and tried to avoid the boy, according to the lawsuit. It didn't work. She was sexually assaulted again [in the school library] but didn't tell anyone because she was afraid of being expelled again.

....School officials were notified of the incident and allegedly doubted the girl's claim, saying they'd "already been through this," according to the lawsuit. The girl was also examined and found to have been sexually assaulted. However,

she was suspended from school for "disrespectful conduct" and "public display of affection," her lawyers wrote in the lawsuit.

I'll grant that it's impossible to know for sure what happened based on just one side of the story. Still, a forensic exam after the second rape showed that the girl had indeed been sexually assaulted, a DNA match was made to the boy she had accused of raping her, and the boy then pleaded guilty to charges in juvenile court. But the school district continues to say that it bears no responsibility for any of this.

I have had the same thoughts in the back of my mind,. There are too many what ifs, the story is far from clear. Is she older or younger than the boy? Is the boy also of similar mental capacity? As for a rapist, if that's what he is, attacking yet again, sorry but you are mistaken. Perps will do it until they get caught. She did try to avoid him, which would lead credence to the idea that he was the aggressor. He plead guilty in court, if he was attacked by her, why would he do that?

Based on the fact that they were in the same school for all the years this happened, they must have been the same age - middle school is only 6th-8th grade.

The boy also finally plead guilty when it all came out - after the school district mishandled it - so if he wasn't guilty of something, you'd think his lawyers would be defending his case better and specified how he was, in fact, the victim.

It should have been handled by the police - not the school district.

The police can do very little in these cases.

Pleading guilty in juvenile court often does nothing more than "getting it behind them" so they can move on with their lives. Why have an expensive, long, drawn out court case when he can do 12 hours of community service and get on with his life?

The police have the proper jurisdiction in these sorts of cases. Now, why would you spend the money to fight a case like this when you can do 12 hours of community service? If that is your response, then I hope your family is extremely wealthy and you have no intention of going to university or getting a good job, because a criminal record precludes you from certain services and opportunities in society.

Do you really think a 12-year-old rapist is going to be held back because of what happened in school?

You ought to know, what happens as a juvenile is sealed when it comes to background checks for jobs and even most universities. It's not a given that this will impact that kids life at all. Now, what will impact his life - and what all of you keep ignoring - is the fact that he's a 12-year-old rapist.

The boy is F'd up. His parents probably had no trouble reaching a decision on taking the "best available option" to make this little incident go away. Pleading guilty to a charge in juvenile court does almost nothing at all to harm him in future life.

He has problems though and it's not like a juvenile record is going to hurt him. His problems will have way more of an impact on his life than any paperwork will ever have. One poster on here said something to the effect of him not being able to get a job because of this conviction. That's hogwash. If he can't get a good job it's because he rapes women at work, not because of a conviction several years before.
