I-864 Sponsor and joint sponsor docs question

Hello

Sorry if this is covered in a million other places but...

My husband is sponsor but has only just started a new job. He earned enough in his old job, and probably will in this one but has only been doing it a week or so. I have a joint sponsor lined up too. My question is, is it best to send both lots of I-864s and supporting docs to be on the safe side? My husband doesn't think he kept his pay stubs for the last job, and will only have two for this one by the time it comes to send it all off.

Also, what are the exact documents both he and the joint sponsor need? I am under the impression that they both need to send in an I-864, 3 years tax returns, pay stubs (for how long?) and the joint sponsor needs proof of citizenship. What else? I'm racking my brains trying to work it out, but I keep reading contradicting things and I really want to get it right so I don't get an RFE!!

I've read the FAQ on the Gov website but it still doesn't make sense to me :( Help would be mucho appreciated, thanks!

Also, I forgot to add, hubby didn't file for 2008 due to half mix-up, half just not filing because he's a bit rubbish with paperwork (hence why I'm on this, not him!) so would this get us into trouble? What would he need to submit instead?

07-03-14 - ROC interview - approval pending delayed background checks

07-25-14 - APPROVED! 10 year GC is finally in production!

08-01-14 - 10 year GC in hand. The journey has finally ended. :)

2014 to 2020 - Living paperwork-free and focused on me!

11-09-20 - N-400 filed online - welcome back VJ fam!

6-22-21 - Interview in Nashville, approved! And then...

6-22-21 - Pledge of Allegiance taken. Holy shirtballs I'm a US Citizen.

2008 & 2009 IRS Tax transcripts or copy of tax returns are optional. 2010 IRS Tax Transcript or copy of tax return is mandatory. If he is making well in his current job, then he doesn't need a co-sponsor.

Using co-sponsor depends on your hubby's current and 2010 income. If it is barely over the 125% of the poverty level, then use co-sponsor.

  1. Cover letter
  2. Cover sheet with bar code
  3. I-864 signed
  4. 2010 IRS Tax Transcripts or copy of tax return
  5. Copy the latest pay stubs of both jobs
  6. Copy of employment letter (Optional)

For Co-sponsor, if used:

  1. I-864 signed
  2. 2010, 2009 & 2008 IRS Tax Transcripts or copy of tax return (2008 & 2009 are optional)
  3. Copy of his Birth certificate (if born in US) or Naturalization or Passport.
  4. Copy the latest pay stubs
  5. Copy of employment letter (Optional)

USA

01/08/13 - Approved and GC is order for production on 1/8/14

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

It is either of the two and not both. If you have 10 days time, get IRS Tax transcripts (it is free) else just send copy of your full tax return that you filed.

If you send tax returns you also need to send the accompanying W2s etc, but if you send tax transcripts then you don't.

You only need to send the most recent tax return; generally sending more isn't helpful but examples of when it could be helpful is if the most recent tax return was low for some reason, but the previous ones were higher and you want to show that the previous year's low income was just a blip :-)

However, he does need to write the totals from the past three years of tax returns. He should back file for 2008.
