Hello everybody!

Here's a question. A friend of mine, a LPR, has to travel to her home country. She's pregnant, and it is possible that her baby will be born while outside the US. What does she have to do to legally bring the baby back to the US? What paperwork does she need? Does the baby get a visa?

She says someone told her she can just board the plane with the baby and the baby will get her passport stamped with I-551 upon arrival to the US. That doesn't sound very plausible, though, since the baby will need some proof of permission to enter the US to board the plane in the first place.

Neither her nor me have been able to find related information on the uscis or travel.gov websites. Maybe we're missing something.

I appreciate your help.

Well, if the child has a US Citizen Parent and is born abroad then she will have to file for CRBA (Consulate Recognition of Birth Abroad) and AFTER that's approved get the child a US Passport BEFORE the child can enter the US.

If the child doesn't have a US Citizen Parent then it would be a lot more complicated.

No, no US citizen parent. That's why I'm asking.

I found something about Travel Letter that can be obtained for the child. Maybe that's it.

Your friend has only two options :

1: she could apply for tourist visa for the child.

2: she could apply for immigrants visa which she could do in here usa when child get approved tourist visa.

Unfortunately there's no travel paper for lpr born child.

Not sure why a US parent would be referenced when not mentioned by the poster. It isnt any more complicated. A travel letter will be given for travel and the parent will apply for the child wno was born abrord.and who has no claim to US Citizenship currently.

Miami boy... The child will be able to travel back.. No doubts with the parent. Humanitarian Parole into the usa.. Something will happen outside of a tourist visa

Check with the CUSTOMS DIVISION of the US EMBASSY.. Just for reference.. For a LPR travelling to Jamaica with citizenship ties to any country. The mothet/child will be given a letter... A Travel Letter. Check my post back in November 2011 I travelled to Jamaica and couldn't finf my Green Card.. Spoke to the ICE/CUSTOMS and all required for me to travel is the letter. Keep in mind THAT immigration officers might ask that the mother sumbit the I-130 on spot. Also the child needs to enter the USA by his/her second birthday so 2 years old from what I remembered.
