Hi,

Should I file AOS/EAD to USCIS first and then tell NVC about that because my CR1 petition is at NVC?

Or should I let NVC first know that we are planning to do AOS in the US instead of CR1 at foreign consulate and then file AOS/EAD to USCIS?

Please let me know the sequence........

You are best off staying with the path you are on, anything that can complicate things at the USCIS, NVC or Consulate can cause things to get lost or mixed up.

We have decided to do AOS since my wife is on K3 now. Currently I-130 petition is at NVC and I received AOS and IV fee bill from NVC.

Since we are going to do AOS, we will have to notify NVC I believe. I don't know which one should come first. File I-485 and then notify NVC OR Notify NVC and then file I-485?????

Call NVC and talk to some on there about this.

AOS on K3 tends to be filed after the spouse has entered the USA on the K3 visa, there is information on the spruce's K3 visa like Non-Immigrant number, copies of I-94 form front and back, copies of biographic page from foreign spruce's passport as well as page with entry stamp to the USA. all this is needed on form I-485.

The K3 is designed to allow a spouse to wait out the AOS process here in the USA just like the K1.

I did AOS after K3, couldn't afford to fly back home for another interview, and all we did was send a letter to NVC to let them know that I'd be staying and please forward the I-130 file to Charlotte. No complications.

It doesn't really matter the sequence in which you do all this, a K3's AOS is not required by USCIS rule to have an approved I-130, just that they have an I-130 submitted.

You can send in the EAD first, so that she can get that quicker, and then send in AOS if you like. Or send it in all at once, whichever is best for you.

There is no specified sequence.

A good time to notify the NVC that you intend to adjust status is when you return the DS-3032 Agent of Choice and Address form.
