my brother is currently filling out the form I-864A ( we live in the same household), he came along part 2, #13 question "I, THE SPONSOR..and so on and on that he will help him with anything and its asking to list the ppl he will support... do i only put my husband on there or does he have to put his wife, his kid, and my husband>>>...some ppl even told me that its better if he fills out I-864 instead of I-864A even though we live together.... because a lot of ppl that sent I-864A got an RFE asking for I-864.... my income was 10,000..i am so confused about those two forms :/

He lives with you, so you can have him use the I-864A, and combine his income with yours on your I-864. On the I-864A, your brother fills out all of that form with his info, income and taxes, but Part2 #13 is for you to fill out, as you are the sponsor. You indicate there is 1 intending immigrant, and put your husband's info there, sign and date it below. Your brother is the household member and fills out Part 3 #15, putting the 1 named intending immigrant, signs and dates on #16. You both provide supporting docs for your affidavits, tax transcripts, letter from employer and recent pay stubs. Plus your brother will provide proof of being a USC or LPR.

I would have him fill out a I-864 because while you may live together, he is not dependant on you or you on him (presumably), so you are not household members for tax/ support purposes. I don't have the form in front of me so I don't know exactly what Q13 says, but while he is only sponsoring 1 (your husband), he needs to count his wife and kids in his household size also.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I don't have the form in front of me so I don't know exactly what Q13 says, but while he is only sponsoring 1 (your husband), he needs to count his wife and kids in his household size also.

They do not need to be dependent on each other to use the I-864A. They just need to be a household member. Part 2 #13 of the I-864A is the part for the primary sponsor(petitioner) to fill in and sign. There is nowhere on the I-864 or I-864A that asks for the dependents of the household member filling out the I-864A to list their dependents. I suppose the USCIS takes the dependents listed on the tax transcripts for the one filing the I-864A into account when going over their paperwork, but only the household member filling out the I-864A is added into the household size of the sponsor on their I-864.
