Hi All,

I seem to be messing up these posts by editing them, so hopefull this will work this time and I haven't posted this three times, along with my other now nonsensical post. Arrrggghh computers hate me. I just have a couple of affidavit of support questions. APologies if they have been answered elsewhere on the site, but ~I couldn't find relevant info:

#1 The guides on this site state that most embassies require an I-134, but some need a i-864. CAn anyone tell me which one the London embassy requires. I tried to email but no luck. Tried to phone but got cut off. Don't want to spend another £1.20 a minute if I can help it!

#2 Jenni is a grad student and only works part time. She is not earning above the poverty line. Her mom has agreed to sponsor me. Does Jenni still need to fill out a form too? She's crazy busy right now with work, voluntary stuff, studies, wedding plans etc. One less form would be a big help. However, if there is any chance it would prejudice our application then she will of course fill out a form.

#3 Can I include any of my shares and savings to back up our application? Should I take bank statements, share certificates, pention plan info along to the interview? I guess it can't hurt huh?

The London embassy requires the I-134 for K1 K3 visa interview.

She will fill out an I-134 as well as her mother will fill out and additional one.

#3 Can I include any of my shares and savings to back up our application? Should I take bank statements, share certificates, pention plan info along to the interview? I guess it can't hurt huh?

I don't believe so, but it wont hurt, is some cases they will consider this, it helps demonstrate that you wont be come a charge if the state.

We've been trying to change that. There is no Consulate that requires I-864 for a k visa application. Use I-134 like every other Londoner.

She is required to complete an I-134. It's not hard and it doesn't take long, especially if she doesn't have much to add to it.

If you have sufficient funds, you can spare her the pain of completing the form (and her mother) by investigating "self sponsoring". London has been very open to the UKC providing evidence of their own funds and while there is no set amount, the amounts requested have been lower than you might think.

Unless you have funds in excess of 3XPoverty Guideline for your household size, youi *will* need a USC or LPR Joint Sponsor for your Adjustment of Status I-864.

We were sent an I-864 to fill in. I have no idea what visa we actually applied for (I assumed it was a K3) but the whole process started with an I-130.

The I-864 tends to get used at the Consulate for true immigration visas such as CR-1, the K1, and K3 visa are considered to be visitors visas, and use the I-134 form. The K3 is a unique case because it has 2 parts filed I-130 like an immigration visa, and I-129F like a K1 visitors visa, so perhaps the I-130 triggered their sending out the I-864.

Youi indicated elsewhere that you are married and your spouse applied for an Immigrant Visa; that's the kind of visa he applied for (class IR-1--you've been married +2 years).

Your profile shows K-1, which is for a fiance outside the US when the USC is in the US.

That visa will always require the I-864 affidvit of support. K-3 is something else altogether again. :)

*shrug* OK. I have to admit that I have never fully understood what I've read online about US visas because the information is inconsistent and written in byzantine language. I also don't understand a lot of the jargon used here.

I often answer this question by pointing out that there is not requirement in law that the fiance(e) or spouse of a K-visa applicant be the sponsor, and suggesting that the only way to find out what your consulate is expecting or will require is to run a little experiment - have both financial packages on hand but submit only the one from, in your case, Jenni's mom. If they accept that alone, fine. If they want Jenni's also, even though she does not qualify to sponsor you, pull it out and hand it over.

A year or so ago two VJers applying in London tried this and found that they were not asked for the petitioner's financial information. The consulate was satisfied with the information from the offered sponsor only.

That being said, I will only suggest that you try the experiment to give us a 3rd data point. Two is not much to go on.
