Should my fiance come to interview and what is AP?

Hey guys,

I might be getting a little ahead of myself as we have just started the paperwork for our fiance visa. We have not yet filed. Hopefully sometime this week when everything is in order :)

Im just wondering how strongly people recommend having your fiance at the interview? I was reading trough all the reviews of the embassy here in Dublin and most people seemed to have their fiance with them. It shouldn't be a problem for us, but my fiance work schedule is crazy and unpredictable. And due to her line of work, some jobs just cant be missed as they could be once off opportunities.

Also im curious to know what AP stands for :)

Ireland is obviously a very low fraud country, so where some people in high-fraud countries would want their fiance to be present at the interview in order to overcome suspicions of fraud, you wouldn't need to. If you want your fiance there, then it's fine.

AP can stand for "Advance Parole" which is a temporary travel permission while the Greencard is pending, or "Administrative Processing" which is extra name checks and verification that occur after the interview, usually in high-fraud countries or with beneficiaries with criminal backgrounds.

Thank you so much for the information! Yea im sure Ireland is a low fraud country, the only thing is I have been refused an F1 3 times this year. We have strong evidence of our 3.5 year relationship. The only thing that scares me is the interviewing officer not looking at the evidence. This happened to me with my F interviews. And theres another post on her of a K1 being denied and the evidence not looked at :( . . What is your thoughts on that?

No, I have had multiple visa, M1, J1, B visas, and haved lived in US quite a bit, never did i overstay or anything. On my first interview after returning in January the CO said he was issuing me the visa, then a week later passport returned with the 214b refusal letter. I then re applied same month, got same guy he said ill get someone else to give you fair chance. And it was a few questions wouldnt look at my evidence and said no. I re applied this past may and got the same guy again he remembered me and again referred me to another officer then same thing. I feel this time the officer interviewing felt a little sympatheic and believed me, yet wouldn't look at my paperwork and refused me again :( I mean my main reason to want to return is my fiance, but i was looking forward to going back to school also and getting a degree.

Do they know you have a significant other in the States? If they do, that could be a reason why they refused to issue you a F1. Applying 3 times in 5 months plus the fact that you've been in the US a lot might be reasons too. But those factors shouldn't impact your K1.

214(b) deals with immigrant intent. The CO obviously believed you intended to immigrate. If they somehow knew you had a fiance in the US then that would explain why they suspected immigrant intent.

It won't be a problem with your K1. Immigrant intent is presumed and expected. In fact, this is how they WANT you to come to the US if you intend to marry a US citizen and stay here.

Do they know you have a significant other in the States? If they do, that could be a reason why they refused to issue you a F1. Applying 3 times in 5 months plus the fact that you've been in the US a lot might be reasons too. But those factors shouldn't impact your K1.

To my knowledge they shouldnt know. But the other factors are quite possible. Hopefully it has a positive effect on my K1 :)
