US citizen and visitor visa fiance ..asking help..!!?

iam planning to marry out side the US in nov 2011 my fiance has visitor visa but she never visit to US.

so after marriage can she come to US with me on her visitor visa. than i will file I-130 and I-485. so does she have to go back or she can stay and get green card

That is immigration fraud. You cannot do that.

It totally depends on the POE officer if he is satisfied by her explanation or not. She has to give reason for visit and also prove strong ties to her country to go back. Since you will be filing for I-130 and I-485 later so I suggest that she shouldn't lie about her reason to come to US. After knowing that, I don't think the POE officer will let her in. Also, for you to apply for I-130 she has to go back to her country.

The legal way to do it is to get married outside of US and file for CR1. Then she can apply for visitor visa. If she gets denied she will have to wait for CR1 approval. If she gets approved she can come here and leave before the visa is expired. Any other way would be considered a visa fraud and would cause life time ban.

While you apply for CR1 she would have to wait in her home country. When she enters US after marriage she will have to disclose she is married to USC, most CBP officer would not let her enter at that point as that is circumventing the laws.

If she lies to officer and she is caught while doing an AOS it would be considered mis-representation which can carry a life time ban.
