LPR's Wife to USA - What is the process?

Hi,

I am sure this has been asked quite a number of times here, just that I cannot see any in first few pages.

I am currently an LPR in US for 4years 5 months now. I will be eligible for citizenship application in March 2011. Recently I had been married, she lives outside US and never been to USA before. Now I want to apply for her so she can come here and finish her studies here.

My question is, what should be the process? I understand I have to file I-130, G-325A for her PR, which will take quite a long time (as far I remember the current date for F2 category is 2008)

1. Can I change my category once I become citizen? will that save time if I apply now or should I wait for citizenship and then apply?

2. Other than I-130, what other options I have to bring her here? If there is any other, please mention if she will be eligible for studies and employment.

3. Other than I-130, G-325A and G-1145, do I need to submit anything else for F2 category?

4. In I-130 instructions, document requirements mention " joint ownership of property (E)", "joint tenancy of residence (F)", "co-mingling of financial resorces(G)", "birth certificates of children born to us (H)", "affidavits by third parties(I), "any other relevant document(J)". I have none of E through H. What exactly they mean by I, and if I cannot secure a "I-affidavit", what else can be submitted as relevant document to show this is an ongoing marital union (that we are married) other than the marriage certificate ?

Thanks.

You can file I-130 now and then upgrade the petition when you become a US Citizen. The I-130 is the beginning of a path that will lead her to entering the US and triggering her own Permanent Resident Status.

Regarding proof of a bona fide marriage, if you have no financial mingling, you can include anything you would think validates a "proof of relationship." An affidavit is a statement from someone you know who describes what they know about the marriage and verifies it is real. You would ask someone to write one. Good luck.

AOS for my husband

ROC:
