Proof of Marriage

My fiance and i were going to apply for a k1 visa but then decided that it wasn't the best choice for us because of some of the restrictions it had on working in the US. So we furthered our research and came across the CR1 visa and it caught our eye, but when reading over the process we got a little confused on the "evidence of a bonifide marriage" part. we were thinking that my fiance could come down to Argentina and get married but we don't know how to prove that its real even though it is.

Thanks!

To be honest if I had done the research I would have gone this route instead of the K-1.

This is from the VJ guides, I hope it helps.

1.Documentation showing joint ownership or property; or2.A lease showing joint tenancy of a common residence; or3.Documentation showing co-mingling of financialresources; or4.Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or5.Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage); or6.Any other relevant documentation to establish that thereis an ongoing marital union.

Good luck!

We would have done this route but received bad advice, this alleviates the waiting for a green card in USA and everyone can keep a normal life and everything goes faster. My wife says butt I am here not waiting in China, time line does not support it. Faster overall to get married them apply, my opinion.

In Arizona its hot hot hot.

Yes, CR1 process is better than K1 visa. You should be able to get a marraige certificate in Argentina from registrar of marraiges or some government authority. This is a must. Then you can get two or three notarized affidavits from relatives/ friends that witnessed the marraige or know that the marraige is bona fide.

Yea we actually saw that chart but the problem is is that we don't have any joint property or any of those things and the time we have spent together has been a few months here and there.

Inter-mixing of finances is only optional/ additional evidence. It's alright if you don't have, which is the reason why I suggested 2 or 3 notarized affidavits. Also send 5 - 10 marraige photos with your relatives in the pictures.

You can't open joint accounts in US without a SSN, so USCIS and NVC knows that.

Thank you for the help. This has been really helpful. How difficult is it to do this process without an attorney?

Very easy. I did everything on my own and my case was just completed yesterday at NVC and I am waiting for interview to be scheduled. VJ is your best resource - ask question however small they may be and you will get wonderful response at each step of the whole process. When you are ready to send the I-130, list all the documents you are going to send and get a confrimation before sending. That way a day delay is good than getting a RFE (Request for evidence) which delays soemtimes by a month.

For New marriages they don't expect much beyond proving you're married. For Joint Accounts if he USC can open an account with you in your home country that would work. Otherwise just prove that you got married.

Almost everyone here is doing it themselves--it is exceptionally easy if you can just follow the directions even when they don't make sense. If you fight the system with what you think is a better way, it will be nothing but delay and frustration.

So get married soon, file for CR-1 right away, and in 8 months or so--a little more, a little less--you will have your green card.

Joint property or accounts are not a mandatory, all you need to provide is the some govt document like marriage certificate, more they would wanna see pics who attended your wedding etc.

Lot of ppl include the small things like copy of wedding invitation etc. All they want to see is this is not a sham marriage for the purpose of immigration and its a real marriage.
