Timeline

Has anyone heard of,or have gone thru the process of bringing a stepchild to America? I have heard that if you are married for 2 years the child qualifies for a 10 year green card.Has anyone heard this or something similar to this? Thanks!

If the petitioner and the child's natural parent have been married for two years the time the child enters the USA, yes, the stepchild is entitled to full LPR status and a ten year green card. The USC files an I-130 for the child and they pursue an IR2 visa.

If the petitioner and the child's natural parent have been married for two years the time the child enters the USA, yes, the stepchild is entitled to full LPR status and a ten year green card. The USC files an I-130 for the child and they pursue an IR2 visa.

I'm not sure if we can qualify for an IR2. In researching it says he must be an unmarried child under 21 of a U.S.Citizen! I'm a citizen and he's unmarried under 21 but, he is not my biological child. On the document cover sheets that need to be sent in with the AOS form and application for immigrant visa has CR2 on the bottom of the page. My wife really wants to have him receive a 10 year greencard instead of the 2/10 scenario. Based on this info,do you think we would qualify for IR2? I saw where you mentioned I have to pursue the IR2.Is it too late being that they listed CR2 on the forms? Everytime I call to try and get answers,I'm put on perverbial hold!! Any help is much appreciated. Thanks again!

If you married mom before the child's 18th birthday, you can petition for him. File Form I-130. This will be an Immediate Relative case as long as you petition for the child before his 21st birthday. Read the instructions for Form I-130 - it doesn't matter if he is not your biological child - you can petition for him as if he was your child as long as the marriage to his mom occurred before his 18th birthday.

If the child enters the US after you have been married for two years, the child qualifies for a 10 years green card. It doesn't matter whether the child enters on a CR-2 or IR-2 visa. If he receives a CR-2 visa, make sure he enters the US after two years of marriage and have him provide proof when he enters the US.

There's more than one kind of IR2. This IR2 visa holder is only entitled to LPR status upon entry because he's a stepchild. The process and visa category are the same but the result is different upon entering the USA.

As long as you married and became his step-parent before he turned 18 step-child = child for immigration purposes.

We're at the NVC stage for our second little guy (7 yrs old), since I've been married to his mom for over 2 yrs he was categorized as IR2 so he'll be issued a 10 year greencard.

Your second sentence is correct but the first one is not. IR2 is also the visa given to natural children of a US Citizen who do not qualify for citizenship UNTIL they arrive in the USA. Those children don't get a green card. They get citizenship. The process of obtaining the visa is the same except the "child" needs an I-864W instead of an I-864.
