To update: My stepson I-130 Petition: Received NOA1 dated 8/19/2011 and priority date of August 18, 2011. So, just in time prior to his 21st birthday, September 16. Thank God for the (CSPA - Child Status Protection Act) woot woot!!! Thank you all for your help!!! Wish you all the very best!!!

1. Now that my stepson has aged out...(Although, I-130 was received before his 21st birthday!) Is his category technically changed from IR2 to F1(unmarried sons/daughters of USC)???

2. Surely he qualifies under CSPA... Does this has a bearing on visa availability for IR relatives or he has to wait for visa available to F1 derivatives???

Your stepson's age "froze" when USCIS received the I-130. This is an IR-2 case. It does not change when he turned 21 years old. CSPA is the reason why he doesn't age out.

He didn't age out. His CSPA age is the age he was on his priority date, and it won't change.

Hello, again!!! Happy April 11th to all!!! As you could see, I am in the process of taking care of the AOS for my Stepson and just wanted to make sure that I am doing the right thing here (with my joint sponsorship AOS, specifically the Form 1040s and Tax Return Transcript for 2011.)

Can I still use the previous 1040's (2010, 2009 and 2008) which I have submitted for my wife's petition last year or would I have to wait till the 2011 income tax return gets processed? Thank you in advance for your help and input.
