answered NO where it suppose to be YES(criminal question) !! HELP

hi, long story short :wacko:

i answered NO on the question 10 where ask you about your criminal background.

i only thought about they consider 5 years of my criminal history to check.

but i read other thread saying i have to disclose all the charges no matter what.

ok, i have 2 criminal cases.

back in 2004, i was arrested for petty theft under $50, i paid fine of 300 and it reduced to infraction.

there was no probation, no community service or classes, no jail time.

this infraction is in the process of expungement now.

and same year, i forgot to turn in library books and media.

they charged me petty theft misdemeanor.

paid the fine and case disposed immediately.

on the disposition this only shows as disposed,

so i went to the court to get disposition to present during the interview.

(i am thinking to take this disposition and explain to interview officer about how i was "misunderstanding and wrong interpretating of the words used on the N-400")

i can still amend n-400 during the interview without penalty, right?

have any of you amend n-400 ???????

also, is it better for me get expunged the infraction before the interview( attorney said it will take about 2 months but my interview is scheduled in 4 weeks) or expungement doesn't really matter under the immigration matter?

Sure.

As I state so often: "you can dance until the music stops and the music plays until the interview is over."

It is part of the interview routine to make sure every question has been answered correctly. Once sworn in and seated, you should tell the I.O. right away that you discovered that you made a mistake on the form and would like to correct it. Happens all the time and is no big deal at all.

Better late than never. Bring it up with the IO so it doesn't look like you were trying to hide it. You won't be the first to amend N-400 and certainly not the last. The IOs see this all the time. Good luck.
