Can US visitor visa be requested before or during CR-1 processing application

Greetings all,

I got married last july. My wife is a US citizen and we intend to apply for CR1 at the end of august or the beginning of september. The problem is that I can not wait to see my wife because I miss her so bad. She will come back in haiti( my country)in november. I see that it is too long and I could not wait anymore. I want to apply for a US visitor Visa ( B1 or B2). Do u think I can do so? If yes, can I request the visa before I start the process or I can do it while the process is ongoing? Please advise guys. Thanks all

Legally, you can apply any time as long as you disclose in the B1/B2 visa application that you are married to USC. However, being from 3rd world country and considering that you have a wife in US you have no chance of getting approval for B1/B2 visa.

i dont think he has NO CHANCE of getting approved. difficult it is but not impossible. he just would need to prove that he has strong ties to his home country. the wife thing definitely makes it harder but not impossible. if i were him i would go ahead and file for the CR-1 and then apply for the tourist visa. that way the CO might see it as - he is doing the right thing but he just wants to visit his wife while the process is going on. which i believe that's what he wants to do.

It is IMPOSSIBLE. I highly encourage NOT to do this because it is a waste of time and more importantly MONEY. There is a 0 chance for an individual from 3rd world country to do it if you have US citizen wife. This is true for any country, even Russia. Ties will not work as he already hinting the intent to immigrate. It will not hurt your chances in the future if you are honest. So, if you really want to you can apply, just be hones. However you have absolutely ZERO chance of getting visa approved. Just don't give wrong ideas/suggestions if you don't know!

This is not nice! If I could give a good advice how to do it I would! It is just no chance in this particular case, unfortunately.

san diego can be a little direct sometimes, but you are going to waste time, money, and energy, and the outcome is 99% that you will not get a B1/B2 visa. Why not spend you efforts on something you can get--the CR-1. And you are desperate because you won't be together until November--are you kidding me !!

i dont think he has NO CHANCE of getting approved. difficult it is but not impossible. he just would need to prove that he has strong ties to his home country. the wife thing definitely makes it harder but not impossible. if i were him i would go ahead and file for the CR-1 and then apply for the tourist visa. that way the CO might see it as - he is doing the right thing but he just wants to visit his wife while the process is going on. which i believe that's what he wants to do.

Does not matter however strong ties he shows, its nearly impossible to get a B1/2 while awaiting CR1.

Coz on one application you say you have no intent to immigrate, while at same time you have another application in line to immigrate to US.

Also lot of ppl have mis-used the B1/2 entered on it and then filed for AOS so CO is not going to approve B1/2.

I can say its worth a try. I am married to a US citizen. we got married last October, and I haven't filed my IR1 yet. We are both working abroad. I made an appointment for my B2 visa. I clearly stated that I am married to a US citizen. They asked me a few questions, and I just told the truth. I got my B2 visa(10 years), and I just returned from a trip to the US with my wife, and we went through customs really quick, No problems whatsoever.

it is definitely worth a try,

04-04-2012- I-130 filed at Seoul US embassy $420
04-19-2012- I-130 Approved(15 days)!!! Receive Case number and Packet 3.
05-03-2012 - Medical examination at Seoul St.Mary's Hospital(Passed) $170
05-05-2012 - Set Interview date for June 15
06-15-2012 - Interview (Approved) Case completed in 74 days! Could have been shorter!
06-18-2012 - Receive visa + brown envelope.
07-19-2012 - POE(Honolulu, Hawaii)
07-24-2012 - Receive SSN
07-29-2012 - Receive 2 year conditional Green card
08-02-2012 - Apply for State ID: Get 6-year Tennessee state ID.
03-22-2013 - Do written test at DMV for drivers license. Get 1-year Learner permit.
03-28-2013 - Pass drivers license test. Get 5 year drivers license. Done with the DMV until 2018!

Next step - Removal of conditions on green card: May 2014.

04-30-2014 Filed I-751 to remove conditions

05-05-2014 NOA1 receipt and extension of green card for 1 more year while it processes.

06-12-2014 Biometric Appointment

12-29-2014 Approval letter from USCIS with no interview needed! Done with USCIS till 2024 or when I apply for US citizenship. 

12-30-2014 Receives 10 year permanent green card.

06-29-2017 N400 filed 

07-05-2017 Check cashed 

07-11-2017 Received biometric appointment

07-12-2017 NOA 1 receipt 

07-26-2017 Biometric appointment 

09-13-2017 Case in line for interview 

04-23-2018 Interview (Memphis, N 400)  Passed!  Recommended for approval. 

05-24-2018 Oath ceremony notice was mailed. 

05-29-2018 Oath letter received. Date set: June 21st, 2018

06-21-2018 Oath ceremony: I am a US citizen. Done with USCIS (Day 332) 

 

Passport application:

06-22-2018 Apply for US passport and passport card 

06-27-2018 Passport application received and in progress. (Day 5)

07-11-2018 Passport and passport card mailed out. Expecting it by 7-17-2018. (Day 18)

07-13-2018 Passport book received.  (Day 20)

07-16-2018 Passport card and naturalization certificate received. (Day 23). 


Process complete: Time to start traveling.

Not far off.

I have seen some really weird cases get Visa's, so definitely not impossible.

The only thing is definite, if you do not apply you will never know.

Haiti ain't South Africa, unfortunately.

Other then that if you read previous poster comment he says him and his wife (USC) dont live or work in US they work out of US.

In that case he might get B1/2 little bit easily under benefit of doubt that they would return back where their jobs are and would not live in US.

I saw someone from Philippines get a B2 visa while I-130 was pending, so not impossible. The visa was single-use and expired in a few weeks, but it got her to the US for a few weeks, which is what she wanted.

I totally Agree, it's hard but not impossible. but you have to take into consideration that you have to pay the processing Fees and none can assure you the success, so you can waist your money in case they deny your B1/b2 path.
