Filling documents for AOS and EAD

Hello Everyone ....

Well., we got married guys :dance: and now we are about to start filling our paperwork , for AOS and EAD. First thing we are wondering about is, on the forms im supposed to fill in, do i write my "new" name? Since its changed now from what it is on the passport and on the K1 visa, as well as the I- 94.

When filing for AOS you can change your name to your married name if you so desire. Just remember that when you tavel internationally the ticket must be in the name on the document you wil be using as ID -- i.e. your passport. Upon re-entry to the US you will show your GC and most recommend carrying the marriage certificate to help the CBP make the connction between maiden name and married name. My wife has decided to keep her maiden name for now. She may change it at naturalization, but for now the name on all forms of IDs match.

Yes. From this point forward you should use only your "new name" unless it asks for "names you've previously used."

When you get your green card, it'll have your new name on it. It will be different from your passport, but all your "American" documents (green card, drivers license/state ID, insurance cards, student IDs, etc.) should be in your "new name." You ARE your new name now. Congratulations!

Use your new name if at all possible. We still had a terrible time when my wife got approved for AOS. They never updated their computers so it took a long time for her to get a social security number because the computer at USCIS didn't show her new name until we finally started to complain.

If you are applying for AOS, you might consider not also applying for EAD. My wife got her work permit two weeks before the AOS interview and they confiscated the EAD card at the interview. You will probably save some money too. :thumbs:

Just read that if you apply for AOS, then the EAD fee is waived. We had to pay a separate fee when we filed. :crying:

Thank you all for your help and advices, because we really need it. We are just about to start with all this, so im sure a lot of new questions will pop out along the way. We got the social security card in the mail so now we will go and change the name there for a start, and after that we will continue with the forms.

We read on the guides that EAD, travel permit ... go along with the AOS (under the same fee).

Will it affect my EAD if its sent in the same package with the documents for AOS??

We are confused on that one .... cause i dont really understand how they process the whole case. We would appreciate any advice you may have for us.

S-Bone: Apply for EAD and AP (advance parole) at the same time as AOS. They are three separate packages that end up being mailed in the same envelope. The EAD and AP packages will be far easier than anything that you've had to do so far.

Married, huh? Pictures or it didn't happen, no man! :)

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
