Hi,

I looked all over for this answer. The K-1 (Fiance Visa) is concidered a NON-IMMIGRANT Visa. I read thru Packet 3 and 4 and it asks for the DS-230 to be provided for IMMIGRANT VISAS (K-3 etc).

Many of what I have read tells me I need to provide a DS-230. Thus, I am confused.

Does anyone know if:... We have to send a DS-230(patr 1) with our KEV-1 (Kiev checklist) to the coloslate??? ... ALSO: Do we need to provide a DS-230 (part 1 and 2) at the interview???

K-1 is non-immigrant visa but it needs to meet the requirements for immigrant one.That is why you are confused.

About the DS form i am not 100% sure but i think that you need to send the embassy part 1 and to bring and sign in front of them at the interview part 2.

DS-156 Question:

Also, question 36 on the DS-156 asks if "anyone has ever filed an IMMIGRANT visa petition on your behalf?". As I understand, the I-129F (Fiance Visa Petition) is not an IMMIGRANT petion, correct? So we only have filed an I-129F, this answer then should be "no", correct? OR "yes" if the I-129 is also covered under this

question.

When your Fiance arrives in the US, she is a non immigrant.

After you marry and adjust status (AOS), she becomes an immigrant. This is why you need both forms.

Everyone needs to supply DS-230 part I.

DS-230 part II is Embassy/Consulate specific. Check the website for the US Embassy Ukraine for further guidance.

On the DS-156: They want to know if any other US citizen has ever petitioned your Fiance to the US.

I only submitted Part I, nobody ever asked for Part II of the DS230.

Removal of Conditions Timeline:

03/19/2008 - package sent to TSC, let's hope for the best

03/20/2008 - check cashed

03/26/2008 - case sent to Vermont Service Center

04/17/2008 - Biometrics scheduled

05/19/2008 - received I551 extension stamp via INFOPASS

02/12/2009 - APPROVED

02/21/2009 - GC received...no mistakes...valid until 2019
