Hi,

I have met an American girl online, we've been chatting a while online, and on the phone. I've just recently got back from a month in the USA on a Visa Waiver program.

If I were to visit again soon, is it safe to tell customs/immigration that I have a girlfriend in the USA? Would common repeated visits be ok? Or would they be suspicious about it?

You should be fine just make sure you bring evidence that you intend to return home. A return ticket may not be enough if you guys file for the K1 or whatever. John came to visit me and told them he was here to visit his girlfriend and they didn't really hassle him at all.

8/10/11 STILL NO NOA1!

8/12/11 Called USCIS to get receipt number-NOA1 will be resent

8/16/11 Received NOA1 with date of 7/20/11

1/3/12 NOA2!!!

1/12/12 Got email notice we are through the NVC.

I believe if you start going very frequently they will not like it but as long as you bring evidence that you intend to return home then the next few visits should be fine. It is good to tell them you have a girlfriend there, but only if they ask.

Timeline

I travelled back and forth explaining that I was visiting my US Girlfriend without 'returning home Docs', although they did ask how I would support myself without a job and I just said I temp for a few months, save up and spend it on a trip to US, when I run out of money I go home and she comes with me, thus the cycle continues!

Yeah, I visited and brought tons of evidence but they didn't want or ask to see any of it

Just be careful not to violate the intent of the visa. If you begin making repeated, frequent trips and they do find out that you are involved with someone here, they may determine that you have immigrant intent and revoke the visa that you have. A similar thing happened to my girlfriend (now fiancee). She came here on a B2 tourist visa. We met here and she was making frequent trips from Mexico to see me. She was stopped at the airport upon entry one time and questioned for a few hours. The frequency of the trips probably raised suspicion. They ended up revoking her tourist visa and she had to return to Mexico within 24 hours. Fortunately, because she was honest, they did not apply any penalties to the revocation, but that sort of thing can happen. I wouldn't offer the information, but if you are questioned about it, be honest.

Good point, though he said he's here on a visa waiver program so I'm not sure what the requirements are for that.

Visa waiver program means no visa necessary if your country is part of the program. You don't need to apply for anything except fill out an ESTA online (Electronic System for Travel Authorization) which is usually immediately approved if you don't have any overstays or criminal background etc. and that's it.

My fiance visits backs and forth, the only time that it was a problem and I received a call from the airport upon his arrival was when he was between jobs... after that no problem at all. I am concern though after we file for the K-1 Visa...

A friend of the family told me that it is risky for him to visit while the papers are getting processed but Im not sure what she means by that! He has an stable job in the UK and always has the return ticket with him... I cant wait for him to be home for good!!! Every day is harder!! Im very happy I found this site!

Travellers from the UK do not need a visa to go to America (for under 90 days).

They still have to go through CBP and just being on VWP doesn't mean they will automatically get in. Their passport is still scanned and the can be diverted to secondary inspection and questioned about their intent for the visit. A visa (or VWP) to the US or any country is not guaranteed entry. The CBP will ask the reason for his visit and "lying by omission" is still lying. The OP has the right idea. Just go ahead with your plans and be completely honest and everything will be fine.

I went on holiday to visit my fiance while filing, when the guy said 'what's the purpose of your visit?' I said 'visiting my boyfriend' with a big fat smile on my face. I had with me a work contract, travel insurance to cover the two week holiday period, my return ticket home and evidence of savings but the guy didn't want to see any of it he just smiled and waved me through. I did arrive into San Francisco though and I've heard they are more chilled compared to the East. Generally they are ok with you if you are from a VWP country and can prove you intend to return home if asked. Good luck and enjoy your trip!
