I am currently in the process of filing the I-864 AOS. I am a US citizen living in the UK with my husband (who is a British citizen). We are filing for his immigration to the US with me. My question is regarding question 21 g in Part 5 of the form. We are using my mother as a joint sponsor for our application, which would make our household size 3. However, my mom has a dependent listed on her tax return and I'm wondering whether or not I should include that dependent in our overall household size to make it a total of 4. I read in the step-by-step instructions that you only need to include an individual in 21g if you are using their income to reach the required amount for the poverty guideline.

I could use anyone's advice on this issue as I'm just really nervous about entering any info incorrectly. I don't want to leave something out that I should have included in the first place. Any help will be much appreciated! Thanks!

You count YOUR household size on YOUR I-864 and your joint sponsor counts theirs on THEIR I-864. Your mother is not part of your household and you are not part of hers.

ditto, you will file your i864 for you and your husband, your mother has to file another i864 with her household size. including your husband.

I was under the impression that my mother would file an I-864A, not an I-864! There isn't a question regarding household size on the I-864A so that's why I was wondering about it on my form. Why would my mom have to file a separate I-864 when she's a joint sponsor and I thought I read in the instructions that the joint sponsor files an I-864A.

i84a is a contract between sponsor and household members if your mother lives in the house with you then yes she can fill out i864a otherwise it is the i864 form

here are the i864a instructions.

We will be living with my mom when we move back to the US, so is she considered a household member now? My domiciled address in the US is her house. It's so confusing since I'm currently living abroad!

No, she is not part of your household and you are not part of hers. An I-864 from each of you. You were laboring under a false impression. Now you know. Even when a parent and petitioner ARE part of the same household, because the parent is head of household, they should file an I-864, not an I-864a. This is BECAUSE it's the only way to correctly state the parent's actual household size.
