Fiance Visa Approved where is my passport??

My name is Karen I am 24 years of age and my fiance is 25 and lives in the dominican rep. I've been with him since I was 15 years old. I love in New York but am of Dominican descent my Father and his father grew up together which is something we figured out when I introduced him as my boyfriend to my parents. I love this man! I have 9 years with him and have finished College and am currently a school teacher, my fiance works in construction and can do just about anything he is gifted I tell you. We got engaged when I was 18 he proposed to me and gave me my beautiful ring and asked me to be his wife, we both agreed that when I finished college we would definitely be married. I applied for the fiance visa back in october and our interview was on july 26, 2011. The consular didn't ask us many questions being that I've been with him since 2002. She said yes he is approved took his passport and gave us a ticket to go pay to get the delivery service to his home! She said that the notice of Action would expire soon meaning that the visa would expire .... ?? What did I have to do with this or my fiance it isn't our fault that our interview was so late???... She said ok he will receive his visa but you must wait for administration processing... Where is his passport why is this happening and for how long??? I am pregnant and I really want my Fiance here I want to marry him, I haven't stopped crying since that time I left him! I need him here we are both suffering from coming so close and being stuck in this limbo??? What can I do ??? How long is this process???

Fresita - please give us a little more information. Expiration of a NOA, expiration of a visa, and administrative review/processing are all different things.

If the visa hasn't been granted yet, I doubt that your fiance' is in danger of the visa expiring. Was there a NOA provided at the embassy that has some expiration on it?

You might try posting your question in the Regional sub-forum that covers the Dominican Republic too. You may find folks with similar experience.

ok right... The consular told me that the petition has expired based on the notice of action that she wouldn't be able to print out the visa because it would be expired?? I said how could it be expired if my fiance wasn't issued the visa??? She turned the microphone off spoke to a supervisor and they said ok go pay he will get the visa but he will have to wait for the administrative processing to get the dates adjusted...?? I call and they said they cannot give me any other information other than he is under administrative processing, dont get why she said we were approved and they have his passport where is his visa?

Timeline

They said the petition expired not the visa. Generally the consul extends the petition automatically so the petition does not expire.

A petition and visa are completely different things.

AP can take a few months to a year or more for some people. No way to tell really how long it will take.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

AP can take from days/weeks to months. You could call the visa specialist and ask about the status of your fiance's visa. Best wishes! (F)

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.
