How many I-130 do I need to submit for petitioning my sister's whole family?

Hi,

I am an US citizen. I am filling out the form I-130 to petition my sister, her husband and their son to immigrate to US.

1. How many copies of form I-130 do I need to submit? Three copies, each for each person? Or just one copy for my sister?

2. Do I need to submit the birth certificates of her husband and my nephew at this stage?

3. Do I need to submit the original Notarial Birth Certificates or the photocopies are acceptible?

Please note, my sister cannot obtain an original birth certificate, but she can get a Notarial Brith Certificate in China.

Thanks a lot for your help!

One only for your sister. You cannot file directly for a brother-in-law or a nephew. Your sister's husband and son will be derivative beneficiaries on your sister's petition.

2. Do I need to submit the birth certificates of her husband and my nephew at this stage? No. Their information is not required or necessary when filing the I-130 for your sister.

3. Do I need to submit the original Notarial Birth Certificates or the photocopies are acceptible?

Please note, my sister cannot obtain an original birth certificate, but she can get a Notarial Brith Certificate in China. ONLY PHOTOCOPIES at the I-130 stage. DO NOT SEND ORIGINALS.

Thanks a lot for your help!

Thanks all for the fast help, especially Jojo92122! This forum is awesome.

One more dump question:

If I just need to fill out only one I-130. How would the officer be aware that my brother-in-law and my nephew also intend to immigrate here?

Thanks,

April
