Hey All,

My fiancee is arriving to the US at the end of the month and we are planning on getting married in September. I'm trying to figure out now if we should be filing for Advance Parole with this or not because we are planning on doing the Civil go to the courthouse marriage ceremony here and then doing the ceremony next April in her country so her family can all go. I'm looking at the average time from application to receiving the green card and it would have us receiving her green card around the end of February. That gives us a month leeway, but I'm concerned if it should take longer for some reason.

If it starts getting close could I quickly apply then for the Advance parole or does this have to be filed with the I-485?

Why not file for AP with the I-485 just in case you need to use it? it's free when filed in conjunction with the I-485. What's there to lose?

Why not file for AP with the I-485 just in case you need to use it? it's free when filed in conjunction with the I-485. What's there to lose?

is that true? i thought it would be $360 on top of the I-485.

Its free when you file at the same time. Plus you have to remember this is USCIS we are talking about NOTHING is done " quickly " if you need to rush an AP I would not count on that at all. Specially since its not for an "emergency".

Yes, it is true. The fees for the EAD and AP are waived when filed with the I-1485. The total for filing AOS is $1070 with or without filing for EAD and AP.

I would recommend just filing for the EAD and AP with the green card application. It's no additional cost with filing everything together. The extra paperwork isn't that bad if you just follow the VJ guides.

If the EAD and AP are processed before you receive your green card then the EAD and AP cards will allow your fiance to travel and work while waiting for the actual green card.

Don't forget, it's always possible that your medical envelope will slip down the back of a file cabinet or something other silly excuse to send RFE.

At least with AP/EAD you can travel and work while you sort out their mess.

The cost of a few extra photos is worth the peace of mind.
