Sponsor has a bad record/Postponing interview date

I have a few questions...

My brother volunteered to sign the Affidavit of Support, but he is on probation. Could that cause problems?

Can we postpone the interview date? If so, for how long?

06.02.2006-Rec'd NOA1

Mandi,

The State Department does not conduct background checks on Co-sponsors. The fact that he is on probation would not matter anyway.

I am not sure about USCIS during the AOS process (I-864), but it would seem unlikely.

Of course you can postpone the interview, but do you really want to do that? Is there a queue for interviews there?

Timeline

Well, before I came home from India, I had a co-sponsor. But that fell through once I came home. It was all a hoax to get me to come home. So, now I am having to find someone else to help sponsor my fiancé. And my brother said he would, but he wanted to make sure his probation problem wouldn't put a hold on things.

What if the co-sponsor is getting paid cash? The only problem with that really is that he doesn't get paycheck stubs.

So, this is why we may have to postpone the interview date.

I understand the dilemma.

Does he deposit the cash routinely in the bank? In other words, does he have a track record of timely/routine deposits indicative of salary? Can he get a letter from his employer, stating annual income, job duration and so forth? This would be essential to solidify the legitimacy of the cash salary payment.

Are there other assets that he can put into the mix?

Mandi are you looking at the requirements for the consulate in India? Reading their webpage?

Generally the income figure is drawn from the tax return. That will definitely be where it has to show for AOS.

Agreed, the tax return is key. I was thinking all the way through the process, as I think everyone should.

If her "co-sponsor" cannot meet the forthcoming AOS requirements, there is no point in having that person as a co-sponsor at all. In my opinion anyway.

I'm getting the feeling that you should have a consultation with an experienced immigration attorney, one who specializes in marriage-based immigration (as opposed to employment-based) and one who has experience with the IV unit in India. Your case could turn out to be an interesting one.
