Hi VJ,

Here's my situation:

My husband, USC, is sponsoring me IR-1 and our son, 2 y.o. (petitioner is the biological father) for IR-2.

Question #9 here goes:

(Q9: I am sponsoring the following family members immigrating at the same time or within six months of the principal

immigrant named in Part 2 above. Do not include any relative listed on a separate visa petition.)

Does my husband supposed to include the name of our son in 9a or not? It is specified there that "Do not include any relative listed on a separate visa petition." Our son is on a separate visa petition which is IR-2. Or does the petitioner have to submit 2 Affidavit of Support documents?(1 for me and 1 for the 2 year old son?

Please advise. Need it badly. Thanks a lot!

as i understand, your husband is not the biological father, correct?

did your husband file a petition for you and your son? if not, then it is only your name that should appear.

if the biological father filed a separate petition for your son, that case will be treated separately.

My husband is the biological father. We have a son together. But our son would not qualify to get US passport in USEM since my husband became a USC just recently.

Yes, my husband filed a separate petition for me and our son. IR-1 for me, IR-2 for our child.
