Timeline

Patrick just went to take the test for his driver's license. He passed both sections with flying colors and was then informed that since his I-94 would be expiring on September 23, his license would expire on that day as well. We filed the AOS paperwork on September 5th along with his EAD, but have not recieved any documentation thus far. What can we use to get him his drivers license? The office said they would hold his results, but we do need to have some other documentation to show that his legal stay in the United Sates has been extended. Any help will be appreciated!!

April 11 2006 ~ Packet 3 returned to London Embassy

June 12 2006 ~ Interview Date (APPROVED!)

June 26 2006 ~ Entered the U.S. under K-1 Visa

July 06 2006 ~ JOP marriage

September 12 2006~ I-485 Received by INS

September 18 2006~ NOA recieved

September 30 2006~ Married

October 3 2006 ~ Biometrics Appointment (Fingerprinted)

November 16, 2006~ RFE reply received ...didn't even know we had an RFE (INS stated that the RFE was

probably sent to the DR. that did our biometrics)

January 17, 2007 ~ CSC is now processing cases received September 25 (11 days after ours was received) :(

Varies by State, but what you say is the same in Colorado. needed my EAD to get a year DL. Then GC got me a normal DL.

Telling us what State you're in will help in answering your question. Each state is different.

Here in Georgia, my husband was told he needs his EAD (he already has a SSN) to be able to get a driver's permit. We were told the same thing regarding the I-94 too. We were also told he could get an international driver's permit through the AAA. When we called them, they said they did not issue them for that reason and they had no idea why we were told this. So we wait...for the EAD.

But it would be better to call the DMV in your state. It does vary from state to state. Good luck!

I am assuming his license is in English, the only reason I can think of a Canadian requiring a IDP in the US is if it was in French, if there is such a thing.

If you're referring to my husband then yes, his license is in English. The State of Georgia says one can drive on his/her out of country license for up to 30 days. The people at the DMV told us that for my husband to be able to drive in Georgia (before his EAD or GC) was to obtain an International Driver's Permit.

I am only posting our experience and what we were told.

Nope - has nothing to do with language. Canada is a foreign country and many states view it as a foreign country - especially those that are not close to the border. Now, there are discrepencies in the information that is given at State DVMs as well. I am also Canadian and used my EAD to get my Georgia driver's license but I was told in person at the local DVM office where I went with my I-94 and was denied since it didn't have enough days left on it that I could legally drive in Georgia on my Canadian issued driver's license for one year. Karen's husband was told during his in person visit to his local DVM office that he was only allowed to drive in Georgia on his Canadian issued driver's license for 30 days. Same state, same legislation, different advice (both of our Canadian license were in English). My driver's license when it was issued with my one year EAD was also issued for four years - to the date of the expiry of my passport, in fact.
