Hi everyone

I am currently attend Baruch College in NYC. I have 3.8 GPA. Recently, I just got a job that i really love. However, the employer asked me to filled in the form W-9 or W4 I dont really remember. I filled in with my name, my address, and my SSN. I am really worried now and asked him i can work without paid only tips because im afraid it will show on my record. The manager told me that dont worry it will not be on my record because you only work 8 hours per week and 10$/hour. I am really worried if i will be out of status. Can someone please tell me what to do.

Best

An F-1 student visa holder can only work under certain conditions. If you do not meet one of these conditions, you are working in violation of your F-1 visa status. Unauthorized work could could cause USCIS to revoke your student visa status.

Employment

F-1 students may not work off-campus during the first academic year, but may accept on-campus employment subject to certain conditions and restrictions. There are various programs available for F-1 students to seek off-campus employment, after the first academic year. F-1 students may engage in three types of off-campus employment, after they have been studying for one academic year. These three types of employment are:

Curricular Practical Training (CPT)

Optional Practical Training (OPT) (pre-completion or post-completion)

Science, Technology, Engineering, and Mathematics (STEM) Optional Practical Training Extension (OPT)

M-1 students may engage in practical training only after they have completed their studies.

For both F-1 and M-1 students any off-campus employment must be related to their area of study and must be authorized prior to starting any work by the Designated School Official (the person authorized to maintain the Student and Exchange Visitor Information System (SEVIS)) and USCIS.

For more information on the Student and Exchange Visitors Program, see the “Student & Exchange Visitor Program, Immigration & Customs Enforcement” link to the right.

Remember that your manager is not the one that could have a potential problem. You need to educate yourself about what is and isn't allowed and choose wisely.
