I am not sure why I am asking this question since the outcome is about the same... but is this the 2 year GC or a 10 year GC?

My husbands green card expired in May. I still have not renewed it. What is the process of renewing it? Will there be a penalty for waiting this long?

N-400 Naturalization Timeline

You cant renew a 2 year card. You have to apply for removal of conditions. Which is going to be extremely hard for you to do now.

They have already initiated Removal Proceedings on your husband because he failed to renew the conditions on his GC. You can send in the I-751 application with an explanation why it is late and cross your fingers.

Good news: there is no penalty for renewing the card even very late. It always cost the same: $390. Online E-Filing Form I-90, Application to Replace Permanent Resident Card.

From the Code of Federal Regulations 214.6

"(6) Termination of status for failure to file petition. Failure to properly file Form I–751 within the 90-day period immediately preceding the second anniversary of the date on which the alien obtained lawful permanent residence on a conditional basis shall result in the automatic termination of the alien’s permanent residence status and the initiation of proceedings to remove the alien from the United States. In such proceedings the burden shall be on the alien to establish that he or she complied with the requirement to file the joint petition within the designated period. Form I–751 may be filed after the expiration of the 90-day period only if the alien establishes to the satisfaction of the director, in writing, that there was good cause for the failure to file Form I–751 within the required time period."

This is incorrect advice for the OP. They have not removed conditions and there is no renewal for a 2 year card.

wow...this is one of those cases where you wish money could just do it. By no applying for removal of conditions he resigned to the resident status. Unless you can prove extreme condition that did not let you apply on time, he'll be put in removal procedures
