Can a LPR bring their parent over by immigration visa?

Hello,

My wife just recently arrived in the US as a Lawful Permanent Resident (LPR). I was wondering if she can have her mom file for an immigrant visa to come to the states. We would obviously sponsor her but I didn't know if it was possible since my wife is a LPR or will I have to wait for my wife to become a US citizen first? I saw something about an IR-5 for parents but everything I saw on it didn't really answer my question. Also, my wife's mom has a son (my wife's brother) who is under 18 years old so if her mom came over would he come with so we would be sponsoring and applying for both of them or would he stay in his country? Any help would be useful. Thanks in advance!!!

An LPR can't petition a parent, for that you have to be a USC. If she was a USC and petitioned her mom, her brother wouldn't come with the mother a separate petition must be file for him.

Wife can only sponsor parents and sibling if she is a USC. Note when and if the wife attain USC, the mother and brother will have to be petitioned separately. What this means for the PHILL, the mother's wait time is around 10 years and the brother is around 23 years.

Once your wife become a US Citizen, she can petition her mom. Once the mom is here she would be an LPR and the mom can petition her son.

You are a USC right, they still have to become one.

Yes I am, because an LPR cannot petition their parents.

Why 10 years for Mom?

Don't parents of USC fall in the immediate family category where there's no waiting for visa availability???

You are getting a good one! LOL dancin5hr.gif

Read my statement, I did not say it would take 10 years from being approved, my calculation and statement is talking about the whole entire proces from attaining USC, to petitioning and being granted approval. My statement say around, nothing is stated as an absolute.

Now, if you'll wish to give a detail 3 year 5 year timeline, knock your selves out.

Your statement DID NOT mention your "10 years" includes any time it takes to become USC, read that YOURSELF, genius.
