I mailed off my I-129F about 10 days ago and I've yet to hear so it's still early, but I'm trying to keep abreast of what the next step entails.

I'm unemployed, but live off the interest of over $300,000 in Merrill Lynch investments. I'm pretty sure that it qualifies since if it were to be all cashed in it would amount to more than 60% of it's value on paper.

Here's the problem. My half brother's name is also on the account, as it was left to both of us but he doesn't touch it, he basically lets me have the interest. When it comes to the I-134, what happens? He'll be more than willing to be a co-sponsor, but there doesn't seem to be space on the I-134 to do that.

Will he have to do a separate one, or will I have to look into using the I-184 somehow? Looking all over for answers but it's SO hard to find any about this process aside from these forums and this site! Sheesh.

MAY 2004: Met Online

NOV 2004: Andy's 1st stay with me in Florida, 3 weeks.

FEB/MAR 2005: Andy's 2nd stay with me in Florida, 1 month

APR/MAY 2005: Andy's 3rd stay with me in Florida, 1 month

OCT 2005-FEB 2006: I stay with Andy in England, 4 1/2 months

* I Proposed on Christmas 2005 & YES!*

MAY-AUG 2006: I stay with Andy in England, 3 1/2 months

AUG 2006: Andy's 4th stay with me in Florida, 3 weeks.

NOV 2006-JAN 2007: Andy's 5th stay with me in Florida, 1 3/4 months

09/05/06: I-129F Packet Sent!!

09/21/06: NOA1 Received.

12/07/06: NOA2 RECEIVED!!! W00t!!!

03/02/07: Sent off final Packet 3 checklist

03/20/07: Received Packet 4 Letter!!!!

INTERVIEW DATE: 04/19/07!!!!

04/19/07 - INTERVIEW SUCCESS! APPROVED!!

04/26/07 - Passport w/ visa arrives via courier

Delta Flight arriving with fiance on 05/04/07!!!

05/04/07 - Home at last!!! w0000000t!!

06/01/07 - Our 'first' wedding at the county clerk's office.

09/19/08 - Andy walked out. That total dumb-a$$.

You would each fill out an I-134A. Make sure they are notarized.

When it comes to the I-134, what happens? He'll be more than willing to be a co-sponsor, but there doesn't seem to be space on the I-134 to do that.

There's a good reason for that - there is no such thing. Not formally anyway.

If a non-immigrant does not have adequate financial resources of their own they need someone to sponsor them. The law and implementing regulations don't get into specifically who or how many. If more than 1 person offers to put up the money to sponsor the visa applicant the term 'co-sponsor' may be an appropriate word to describe the situation, but it's not something that has a definition or description as to how it works in the INA.

A person who is willing to sponsor a non-immigrant visa applicant puts together a package of finacial information demonstrating that they have the financial resources to do so, almost always including an I-134 affidavit of support in the case of K-visa applicants. If more than 1 call them multiple-sponsors, co-sponsors, just plain sponsors, whatever you want to call them.

Is the documented interest enough to meet the minimum criteria?

If it is - to others on this thread - would that be the 'best' way to file? And if so would a letter from the joint owner of the account (the brother) be necessary stating he does not receive any of the monthly interest income?

Or would it be more clear-cut to just file from an 'asset only' position?

Any takers on this? I've always kind of wondered about sponsorship by those whose sole income is from investments. I personally don't see why it would be a problem as long as its documented?
