Timeline

I live with my parents since I still am in University with a part time job that I only started in April of this year. My parents support me and they would be supporting my husband until he gets a job here. Now since our case is forward to NVC and we have to make the affidavit of support papers, how do I go on with that since I never mentioned in my previous papers to the USCIS that my dad would be the joint sponsor. Also I don't have three years of tax returns or pay stubs.....my dad does though. Will there be a problem?

You will fill out your own I-864, your dad will fill out an I-864 and include relevant documentation with it.

Not indicating to USCIS that your dad will be joint sponsor will not cause you any problems because it was not relevant at that time.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Timeline

Dont worry about it, as long as your father makes more than the poverty level (see Form I-864P ), he can sponsor your husband.

You will need to fill Form I-864 for yourself, and your father will need to fill out Form I-864A .

It's fine if your unable to provide tax papers for the last three years, since your only required to include a copy of your most recent tax form and pay stub as evidence. Including the last three years is recommended, but dont worry it wont negatively impact you if your unable to include them all.

This is a quote from Form I-864A instructions:



"You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income

tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to

maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns

for the three most recent years."



"You may include evidence supporting your claim about your expected income for the current year if you believe

that submitting this evidence will help you establish ability to maintain sufficient income. You are not

required to submit this evidence, however, unless specifically instructed to do so by a Government

official. For example, you may include a recent letter from your employer, showing your employer's address

and telephone number, and indicating your annual salary. You may also provide pay stub(s) showing your income

for the previous six months. If your claimed income includes alimony, child support, dividend or interest

income, or income from any other source, you may also include evidence of ability to maintain that income."

If her father is in the same house he fills out I-864A and if he is not living in the house when they move there he fills out I-864 I believe.

No still I-864. if the co-sponsors spouse also joins then he/she will file I-864A.
