Good night all, I am new to this forum, so please forgive me, if this question has been asked.

My question is: I am from Jamaica and would like to know, after I have received my Permanent Residency to live in the USA, how soon will I be able to file for my fiancé, who is also from Jamaica, to come and live in the USA with me? Also, what is the procedure to do so?

Looking forward to a favourable response and thanks again for assisting me.

Hi. I'm also from Jamaica. Finally some company. To answer your questions. You can file for your fiance after a year has passed. You will need to file taxes to sponsor your fiance. After the year has passed you can apply for an i130 form. You can download it from the net or visit your local uscis office when you get there.

Hi. Wow, small world. :) A year?! That's so long :( So, that's basically it? Wait a year and then file an I130 form, how long will that procedure take place? Is it a year from I am issued the Permanent Residency or a year from I decided to accept and start living up there?

A year from you get your green card. Small world indeed. Well, I've been waiting from 2009, mu mom an lpr applied for me. It normally takes about 3 years. Sorry. When you file and it is accepted you will receive a priority date which puts you in a line to wait for an available visa. Yes I do a lot of reading since 2009, hehehe. You can go to www.travel.state.gov for more information. Hope that helps.

Wow. Ok. That's a long time, good luck with your wait. I have been trying to do some reading too, it is alot and sometimes it varies and contradicts each other, I like just asking the questions and getting the direct answers. Yep, I have been on that website a number of times, it has helped me though.

Ok. Just another quick question, while we wait out the 3 years, can my fiance stay in the USA and work legally? Or is it expected that he has to stay out of the USA? That would be difficult for us to wait another 4 years to get married.

Where'd you get this info from? It's wrong. LPR cannot sponsor a fiancee, only a spouse. For an LPR to sponsor a spouse, the wait time is a few years for a visa to become available. Only for spouses of a USC is a visa immediately available.

Oh no. :( So, just to clarify then, I am expected to get my LPR status possibly this year or next year, how soon after I get it, can we get married and then I file for him?

I am now even more confused than ever before. If you have accurate information, could you also show me where I can find it too, so I can do some more reading on my own as well, please?

Oh, by the way, what is USC? US citizen?

Ok @Anh map, thank you for the information link. I see that my fiance, who will eventually become my spouse, will be given Second Preference (2A), so therefore, after I get my Green Card, could we get married and then I file for him immediately after? While he is being filed for, can he being in the USA whether working or visiting?

How would your fiance/spouse obtain employment authorization? Your petition would not allow them to work, nor would it authorize them to enter the country. Only a visa would allow them to enter the country. Tourist visas do not allow a person to be employed.

I know that he would need a visa to enter the country, he has a visitor's visa and I know that won't allow him to be employed. I want to file for him as soon as we are married, but it seems as if he will have to wait in our home country, while the filing takes place, right? How long after I file for him should he get his visa? Could he still visit while he is being filed for?
