Well we have been approved on sept. 11, what a date to get approved on. Very happy and glad. Now I have some questions on the affadavit of support as we are running into a few problems.

Questions

1- Does the US petitioner, my fiancée, HAVE to sign an affadavit of support or can it be someone else who makes 125% above the poverty line?

2- When the app. is being reviewed, will they take into account that a job you have might be laying you off?

3- What happens when you switch jobs a few weeks before the interview date, does that hamper the application any?

4- To emphasize on my first question, just want to clarify it once again. I would like someone else whom we know quite well to sign the affadavit of support ONLY as he makes more than 125% and he lives alone. Is that a possibility? Can he be the primary and only sponsor or does my fiancée have to submit an affadavit of support form as well.

Well that's the basic questions actually. I'll be going to the interview at the new delhi embassy. Any idea as to the sort of questions they make ask? If you want to give a date for them to interview on, is that a possibility? If you miss your interview date, can you call them up and reissue another date or do you have to reapply for the I-129F again?

1. Yes, your USC fiance *is* the primary sponsor by default. He will still have to fill one out. If he does not make the %125 requirement, then someone is allowed to co-sponsor with him. So both the USC and the co-sponsor will have to have the forms and required documentation.

2. As long as that person is not terminated or quit that job, then yes it will count. They look at the annual income, not whether that person is laid off or not.

3. Try to send the affadavit to be the most up to date and most recent as possible, however, if you cannot, you may notify the CO at the time of the interview, instead of letting them figure out for themselves.

So you're saying that I can't have another person just sign the support form and leave my fiancee out of it if she does not make enough cash. If she's staying in a large household, does the other co sponsor have to compensate for the members in her household as well?

It has to be your fiancee, though if she doesn't qualify she can get a co-sponsor.

2- When the app. is being reviewed, will they take into account that a job you have might be laying you off?

If it's you and you're the foreigner, they probably won't care if you're applying from outside the US. The impression that I got was that they'll only care about the USC's income/assets.

3- What happens when you switch jobs a few weeks before the interview date, does that hamper the application any?

Your fiancee is 99.99% likely to have to fill one in even if her income does not qualify her to sponsor you, so I recommend getting started. If you need a co-sponsor he will probably have to fill in a separate affadavit of support. We had my parents fill one in just in case we needed it since we did not want anything to hold us up (the medical is holding us up right now) but in the end we didn't need it.

I would think they would not look kindly on you missing your appointment and if you ask to reschedule they may bump you to the back of the queue so I strongly recommend keeping your appointment. They will choose the date of the interview; you won't get a say in it if New Delhi is anything like London. Our visa appointment was scheduled for September 11th of this year. I didn't want a visa appt on 9/11, but there you go; that's when we were scheduled!

We were not asked any questions about our relationship; we were asked if we own our home and whether we had put it on the market yet. That's about it; mostly the official just shuffled paper and asked us to hand documents through the window. It was all very quick. The embassy part was a piece of cake; like I said, it's the medical that's slapping us right now.

For a fiance visa, the affidavit of support makes NO mention of household size.

Have you even confirmed that your Consulate requires I-134 for a fiance visa app?

USC fiancee completes one and if her income is not enough for two, or doesn't look stable enough, or if the whole thing does not add up to the foreign fiance not becoming a public charge, then you can add another sponsor's I-134.

Maybe instead of me guessing, you could lay out your concerns?

The concern here is, she has 4 people in the household. With 4 people in the household, it's 25000 that she has to make. Or am I mistaken and she only has to cover herself and myself? Now, when filing the affadavit of support, does she ALSO have to support her family as well. IS that counted. Because if it is, there's no way she's making 25k a year.

Second concern is that we have somebody who makes more money for 5 people in a household however he's going to be a co sponsor. The thing is, I want him to be the only sponsor and therefore negate the fact that my fiancee doesn't have to sponsor. Reason I want that is because he does not have to compensate for the funds for her family IF HER family is counted. For the new delhi embassy located here: http://newdelhi.usembassy.gov/k_visas.html it's the I-134. Household size is NOT Mentioned neither is 125% but basically the USCIS follows the I-864. I'm concerned about this actually.

On the I-864, the person filing the petition (your fiancee) MUST designate herself a sponsor. It does clearly state that if she can't meet the income requirements she can designate a co-sponsor (who must also fill out an I-864). If the I-134 is anything like the I-864, you will not be able to get around this.

I don't see the problem anyway; if she doesn't meet the requirements, no biggie; just get someone who does. The form isn't that difficult to fill out.

Right. We have an alternate solution of course, she moving out on her own and finding a more high paying job but we want to use that as a last option.

CIS may use the same figures for their guideline, but the I-134 does not make mention of "household".

I think you have some misconceptions about I-134; don't let them hold you back. :)
