The CR-1 takes roughly the same time as the K1, but you can only start the CR-1 once married and have the marriage cert in hand.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Ya i was intending to reply on a thread and may be i started one by mistake. wasn't intentional.

Relax guys, we have not gotten married yet. i was just asking how would they be able to find out if lets say we get married in Egypt "AFTER" she gets the visa. like even 1 day before she travels to the US...just to make her family satisfied. Which means after the background checks are done and she has the visa. And we still get married in the US again few days after.

and please...no one needs to get defensive here. im just asking for your opinion not your "conscience" .. lol with all do respect to all of course

just dont do it

Just wondering that the religious wedding are really considered legal. USCIS only cares about legal wedding right ??

t'is a conundrum no doubt, as the others have said i would avoid any kind of fraud pertaining to immigration, however if i were in your situation i would prefer to commit a little "fraud" towards my family. Heck as long as they are happy then all is good, they don't have the power to make your lives a huge pain like the government can, they can just make you feel a little uncomfortable if the truth is ever revealed. If i explained the situation to my parents they would probably understand and agree.

You could still use the K1 and get married in a small "secret" ceremony in the US, apply and receive your green card and then head back to Egypt for your religious ceremony, just dont have an "offical" ceremony.?

I understand cultural differences between my family and yours but hey, they will love you no matter what.

From my understanding is all Muslim countries have 2 things they do to get married a spiritual ceremony and a going to the government for a official ceremony. They could do the spiritual ceremony and not be considered married by USCIS. this is a solution. Because its the spiritual ceremony they hold important. then after and when they go back to visit they can do the official marriage with the government!

anyone that does the spiritual ceremony needs to be very careful because if the embassy knows it they are considered married even if they did not go to an official.....then they have to start all over again........i know of one person that did the spiritual ceremony the girl came back to the states then filed k1 pulled it wanted to marry someone else got a annulment in the state of Texas i believe......they guy found another girl she filed k1 and the very fact that there was an annulment he had to claim he had been married.......needless to say he got NO visa.....

its a catch 22 if you try to get a marriage visa based on it you cant if you try for k1 and embassy finds out about it you cant get k1 over the years i have been on vj i have seen it happen both ways

yes and many times the embassy thinks the engagement was a marriage or they use it as an excuse to either prolong the visa or to ask for proof it was not marriage other times it fly's right thru.......seems most of the issues over this that i have seen are from India embassy

Getting denied for a traditional wedding in Nigeria is very common. Even when Nigerian marriage laws specifically mention it as not being legal. Some people have been denied for engagement parties that look too much like traditional weddings. You need to talk to the family and explain the problem. That if they insist on a wedding before departure you will have to cancel the current process. If there a family memeber with a US visa , prehaps a B1 that could escort your wife to be here and make sure that you are properly married before you co hanit ? It's a long shot but it might allow you to continue down your current path .

This will not be over quickly. You will not enjoy this.

Maybe she could come here and have a civil court wedding, she returns and apply for CR-1. Then go there in the future for a family wedding. That's what many people do including myself. There are many advantages to CR1 vs K! including cheaper, if it is legit it is less likely to be denied than a K! and she gets green card immediately upon arriving and does not have to adjust statud.

Remember, USCIS and ICE don't forget. Here is a link to an article about a filipino Dr and his wife who faced deportation after 25 years in the states. Their only offense is that they said they were single when they immigrated when in fact they were married.

You can take any approach you want to – there is nothing and no one stopping you.

When your fraud would be caught you would be the first person crying out loud how US govt is against you and they against muslims and on and on #######.

You would never agree you tried to cheat the system as per your convenience.

There is no requirement for you to travel back and forth if you file for CR1.

i think you can do this:

after getting a K1 visa,you hold a tradional wedding ceremoney in Egypt and do not register in the government office. this will not break any law. not sure if her parents would accept it. when she arrives USA then register a marriage in USA.

if I was to get married in the UK and not hand in the wedding certificate to the registrars office, does that mean I'm not married? Erm NO it doesn't!!

Because I got married in the USA and cant hand in my marriage certificate to the UK government to be registered does that mean I'm not technically married in the UK? Nope still legally married here in the UK as well as USA.

The way I see it you have 2 choices, carry on with the K1 and get married in the USA after you have received the visa and then go to her home country and have another wedding.

or

Cancel the K1 and go to her home country, get married and file for a CR1.

No one on here is going to/should encourage you to break or bend the law. It's on your own head if you lie about things but you and your future spouse has to be prepared for the consequences of your actions.
