Timeline

My 2 year conditional greencard expires on November 9th, 2011. We were going to send our package on August 9th, which we considered to be the 90 day mark. However, we realized that since there are 31 days in August and October, the literal 90 day mark is August 11th.

Does it matter? Should we wait until the 11th to play safe or are we fine to just usu August 9th as our date?

You would want to play it safe. If they determine that they received it too early they will send the entire package back and considering we are dealing with the USCIS there is no standard so just because they accepted one persons application a day early doesn't mean they will accept yours too.

I would wait the extra day or two and then send but that is coming from someone who was eligible to send theirs in June and only just sent it now (August).

You could send it on the 10th so it arrived on the 11th when it would be acceptable

04/30/09 - Sent I-130/I-485/I-765 from B2 (no I-693 as it is not yet complete.)

05/03/09 - Received email form USPS stating that package had arrived safely and was signed for!

05/11/09 - Received NOA1's for I-130/I-485/I-765

05/16/09 - Received Biometrics Appointment

05/30/09 - Received a CRAZY amount of RFE's that were dated 05/21/09

06/01/09 - Biometrics Appointment Scheduled. In and out in 10 minutes!! Sent off RFE information (Should arrive in MO on Wed.)

06/03/09 - USCIS received RFE response

07/23/09 - I called to have a service request put in

07/24/09 - I-765 Touched (FINALLY)

07/25/09 - I-765 CARD PRODUCTION ORDERED!!!!!!!! (About time!)

08/03/09 - EAD card came in the mail WOOHOO!!!

08/07/09 - Interview letter arrived

09/02/09 - Interview Date

09/07/09 - I think this is the day I received my Green Card.. Can't quite remember anymore.

Removal Of Conditions

08/03/11 - WOW it's already been TWO years! Sent ROC package to VSC.

08/05/11 - NOA1 date which arrived 8/10/2011

09/02/11 - Bio Appointment the notice was dated 8/12/11

There's a difference between 90 days and 3 months. You have to send it within the 90 day mark, which for you would be August 11th or beyond. Do not send it in any earlier or it'll be rejected.

My conditional green card also expires on November 9th, 2011. I am planning to send my application on August 11 just to be safe, although I cannot wait to be done with this whole thing. Good luck to us and to all of those waiting :)

I was going to do the same mistake but then i saw a previous post in another topic and when i counted the 90 days back it was 2 days after the day i thought... so make sure you count 90 days backwards and that is when you shall send your package... I am going to send mine tomorrow!!

I would actually shoot for the 12th as you must file within the 90 days immediately before your second anniversary of the GC and this is the date your CGC expires. Some ####### USCIS person may say that since the valid date is November 9th, the actual expiration date is really the 10th and 90 days before the 10th is August 12th. I would rather err on the side of caution rather than mail it early and have them sit on it for a week or two just to then send it back because it was a day early. I plan to send ours off at the 85 day mark, I hope.

They need to receive it within the 90 day window, and the I-751 form itself needs to be dated within the 90 day window.

:blush: I'm one of the goofs who sent it at 3 months rather than 90 days. It was signed and dated at the 3 months point, the day it was mailed. That would make it signed, sent and mailed 92 days early.

I have been holding my breath hoping it will go through ok. The check was cashed, we got the NOA1, the Biometrics appointment, and we are in the USCIS.gov web site. Am hoping we will be ok. Maybe that is why our biometrics was scheduled as one of the latest? Or does that just depend on the load in each state?

At this stage IMO you are fine; they would have returned your package as soon as they received it if it was too early. Now you just wait.:) Good luck!

We'll be on vacation when our 90 day mark hits, so I'll sent ours when we'll be back. For sure it won't be too early. My husbands green card expires 11/30/11.
