Hi,

I would like to ask you about three year rule/citizenship via marriage.

In 2005, I married my wife who is US citizen and in 2008 I received my Green Card.

From 2005 to 2010 we lived overseas as my wife and I worked with UN in different countries, however once a year we entered US to visit my wife’s parents. This gave me a right to keep my Green Card while living out of US.

In June 18, 2010, I came to US and lived there until Aug 1st, 2011 (1 year and 44 days).

I heard that in order to apply for citizenship I have to live in US at least 6 months +1 day per year, during 3 years.

My question is that will I be eligible to apply for citizenship if I return to US in 2012 and live in US for another 6 months +1 day, given the fact that I live in US from June 18th, 2010 to Aug 1st, 2011?

P.S. on Aug 1st I left US.

If during the time you spent 1 year and 1 day out of the US you clock was reset. Any period > 6 months is subtracted from the 3 years but does not reset the clock. It sounds like you are going to have to wait almost 3 years.

This will not be over quickly. You will not enjoy this.
