Hello everyone.

I've posted on here a few times now. I have some questions about advocate of support.

Me and my girlfriend are soon to be married. I am a f1 student from England she is a us citizen, it should be a simple aos process. We are both in school still and she earns way below what is acceptable as we only have on campus jobs, our education comes first. Now with the advocate of support, her family is very willing to help as they believe in us and our situation. I'm not sure of the exact numbers her mum and dad earns, but they file there taxes together so will they take there overall income or can it only be one of them? Between them they earn a decent amount of money but they also have a large family. A 9 yr old 14 yr old 18yr old and my girlfriend. My girlfriend filed her own taxes but the other 3 siblings are dependents of the house hold. I know the advocate of support has to show they can support the family plus me and be a certain percent above the poverty line (the percent above the poverty line is 19%) please correct me if I'm wrong! So would my girlfriend who files her own taxes be included, plus me, equals 5 siblings! Or would she not count so it would be 4 siblings? Ok last question, we have worked our buts off and saved to get 2000 dollars so we can pay for all the forms and physical, the only problem we see in our aos is the advocate of support, which our quires I've mentioned above! If the worst happenes and the usis decide that her family cannot support me, do we see any of that 1500 dollars it cost to submit the forms, or is it long gone?

It's called "affidavit of support". :blush:

If your fiancee files her own tax returns and is not included as a dependent on her parent's tax return then she's not included in their household size. That leaves mom, dad, three kids, and you - household size is six. Income must be 125% of the poverty guidelines. For a household size of six that would be $37,487. Only one parent signs the I-864, but both parent's income can be included if the other parent signs an I-864A. Your wife still needs to submit an I-864 because she's the primary sponsor.

Make sure you read the guides, download all of the current forms and instructions from the USCIS website, and read the instructions for each form carefully.

If USCIS determines you don't have a sufficient sponsor then they'll send an RFE instructing you to produce an affidavit of support from a sufficient sponsor. If you don't then they'll probably deny the application.

USCIS never issues refunds. You're paying for the processing - not the approval.

You're paying for the processing - not the approval.
