N400 UNDER SUPERVISIOR REVIEW!!

I had my N400 interview on June/13/2011 in NC.I passed the test, but the I.O said he needs to have a supervisior look at it,so I got N652:Decision cannot be made at this time!

Its almost 8 weeks now, and the online status is"UNDER SUPERVISIOR REVIEW".

I called USCIS,they told me to call them back once its been 90 days after the interview!, They also said "USCIS have 120 days after the interview to render a decision"

My N400 is based on a 3 years marriage to a US citizen,I had my driver license suspended in 1989, and in 1994"22and 17years ago". All were taken care off,provided court record at the green card interview, and sent the same along with my N400 application On Feb/2011.

The officer did did not ask for any further evidence relating to this or any other such as tax, proof of marriage/all were sent at the application.

Its been almost 56 days and the online status is static"UNDER SUPERVISIOR REVIEW" :bonk:

Did you get a letter requesting more evidence with a 30 day deadline to respond or to have your application denied? Stepdaughter did with even more outrageous charges. That is when I called my senators office. But without that letter from the USCIS, would have had no reason to call him until that 120 day limit was reached. At first it dealt with proof of paying small traffic tickets, for her was four years ago, but they dropped that. And the only way her IO knew about those tickets was asking her, not even a requirement to submit that evidence.

So they dropped that in her letter and wanted her to respond to battery charges when she was 17 months old. Did give the date, but not the court were these chargers allegedly occurred from.

Seems like a decision cannot be made at this time if popping up all over on the board, in particular in the last six months.

We all we went through to get those green cards doesn't have a thing to do with US citizenship, same old stuff all over again. Guess they figured you got your green card out of a Cracker Jack box.

Maybe that supervisor is playing detective with google. My stepdaughter has a very common name, if I just typed in her first and last name in quotation marks, got 83,000 hits. Adding her middle name cut that down to about 50, adding her DOB cut that down to one where I found that 53 buck fine she got.

then I will wait till Its 120 days to :1.Fill DHS FORM 7001<OMBUDSMAN CASE PROBLEM SUBMISSION>.

2.Contact my state senator.

3.Do an INFO PASS at my local USCIS office.

If none of the above will work, then I fill a WRIT OF MANDAMUS

at the local US Federal Court by myself,because an attorney

will charge an average of $1500-$2500 :bonk:

DHS FORM 7001<OMBUDSMAN CASE PROBLEM SUBMISSION> is a complete waste of time, even talked to a guy on the phone. They just take surveys and make gentle suggestions to the USCIS.

Hopefully, your oath letter will come in on Monday.

Thank you, I hope i will get it as soon as Monday, If not i am going to exhaust every option that I may have.

I think doing that will narrow down the available possibilities.

Oh I have been through Supervisor review for my AOS :) I would suggest Infopass every week and go there. Try to check status with them. Make notes of what time you went, who you talk to.. what did they say etc. Keep all correspondence with Senators etc. Do the Ombudsman thing too. If in the end you will have to file a Writ of Mandamus, you will need all of this. My feeling is that you will have to file it eventually.

Yeah but the OP is talking about traffic violations, doesn't mention why his drivers' license was suspended, but that can be done by failure of paying a five buck parking ticket. Said it was settled and had all the proof, and many years ago.

Your post is far more negative, care to share why you had problems?

Ha, this time I don't mind it, already know the frustration OHMS is going through. For me, okay to vent, but never to the USCIS, just have to be nice, smile, and extremely accommodating.

Yeah but the OP is talking about traffic violations, doesn't mention why his drivers' license was suspended, but that can be done by failure of paying a five buck parking ticket. Said it was settled and had all the proof, and many years ago.

Your post is far more negative, care to share why you had problems?

If you were asking me, why I had problems.. I didn't have any violations.. no record whatsoever.. perfectly legal in every way.. :) when I did file the writ of mandamus and USCIS started to work on my case I talk to the I.O which said that cases that go into supervisor review gets worked on only one day of the week.. and the pile is pretty big.. on the other days they have new cases coming in to work on.. Also, she said that the original interviewer actually put a small red line on it. I don't know why, but since she failed to mention why she put it.. it was gone to supervisory review.. and the original interviewer had left USCIS altogether..

We never expected to be asked for proof of payment of minor traffic violation fines so didn't bring any proof to this effect. Ohms did have proof, but still got a decision cannot be made at this time.

Are you saying you also got a decision cannot be made at this time for not even a reason? And your IO is longer there because of a red line on your application for no logical reason?

Its my understanding that all interviews are checked over by a supervisor and can only guess whether its the applicant is being checked, or whether the IO did their job correctly or not. Now a field office that only checks these applications once a week, certainly not done at offices that have same day oaths.

In our experience with the USCIS we had long delays in that our applications were "misplaced" three times, no other reason was given, that was frustrating to say the least. But tried our best, even to go overboard that we fully complied with all the fine print. I call this luck when an application does go through smoothly.

In my experience working for the federal government, was two ways to get promoted to a higher position, first was to be incompetent at your job, was bypassed by an idiot that didn't know anything, so they made him a supervisor. Having that person be your boss is a bit too much. Other reason is to have a friend or relative in a high position to get that promotion. Do not see where the USCIS is any different in this respect.

Ha, Bush putting Emilio Gonzales in charge of the new USCIS under yet another government agency of Homeland Security because he helped Bush win the election. A Cuban refugee that can't even speak English, he is the one that really made a mess out of the N-400, the INS similar application made sense. Took the American Board of Immigration Attorneys to get rid of him. But since then, only two different acting directors, and still a mess. This is what we are dealing with. So you wonder why we have problems?
