Good day!

In the absence of us birth cert. Passport can be a proof of citizenship when filing i-129F. My question here is, does the passport really have to be valid for at least 5 years as stated in the instruction form?

My fiance's (the petitioner) passport expires Oct. 2012. Does he need to renew it to have a validity of at least 5 years or can we just use this current/unexpired passport??

I'd be glad if you could he us regarding this. Thank you.

If that's what the instructions say, those are the instructions. Your visa journey will be a lot easier if you read accurately, interpret literally, and follow instructions exactly.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

In my opinion he can still use the current and unexpired passport for I-129F submission. It is still a proof that he is a U.S Citizen but Birth Certificate would be great too. Why can't he just get the BC?

Any U.S. passport is valid for 10 years. Only those of minors an some diplomatic passports are valid for 5 years only.

If you are a US citizen over the age of 18, you will have a US passport that's valid for 10 years unless you got mugged while getting a full body oil massage with "happy ending" in Phuket and had to get a temporary passport from the US consulate there to be able to travel back to the United States.

Thank you for the reply. He cant present the BC because he was born here in the Philippines but he's a us citizen through his parents.

That is NOT, what the instructions say. Please note that instructions are written in complete sentences. To follow them, you must read carefully and interpret literally. Now, read the instructions again and see if you don't see the error in interpretation.

It says here validity period of at least five years. So I guess I misinterpreted the meaning of validity period. Because in my own interpretation, validity period means it should be valid for 5 years but in the definition itself it says validity period is the active lifespan for a certain document. So I guess there's a difference. By the way sir/maam, @pushbrk I read one of your replies about having no certificate of citizenship and it really helped us. So, thank you!

You guys have me totallly confused. So what is the answer? Is it asking for a passport that was valid for at least 5 years when it was issued, or is it asking for a passport that will not expire in the next 5 years. Ie. If a 10 year passport was issued in 2004 is that not good enough since it would expire in 3 years? Or is it good for this purpose since when it was issued it was valid for 10 years? Next question, if the answer is "It must still have at least 5 years remaining before it expires then... 5 years left from when? The date they recieve I-129F, the date NOA1 is issued, the date NOA2 is issued, or the date of the interview? Mine is that close to the 5 year mark. Will it still need to have 5 years left on it again after marrying and applying for the next step as well?
