Both me and my fiance live in Japan now, but have plans to make it back to America in the next few months.

So we are looking at 3 main options:

Fiance Visa.

Spousal Visa.

B-2 and getting married (Don't want to do this one, cause know of the problems).

Number one thing...we do NOT want to spend time apart. Number two is that she wants to work ASAP once we go back to America.

Can anyone clear up which options are best for this?

Can we even apply for spousal/fiance visas while we are in Japan and I'm not living in America?

CR-1 is the only thing that will let her work right away.

You would have to marry then file CR-1. DCF is no longer once August 14th comes but you can mail the CR-1 from Japan to the location in the USA listed in the CR-1 instructions on the USCIS website.

AOS was approved in 2 months and 8 days without interview.

About how long until she can begin working once she comes to the US if we were to do a fiance visa and sign the papers basically upon her arrival?

What is DCF?

I read that to sponsor her for a US visa, I had to be in the US myself. Is that true?

K-1 visa will not get her there in a few months, it will take closer to 9-10 months. And then on top of that you have to file AOS after you marry and it takes around 4-5 months to be able to work after filing AOS.

Either you are going to go back to USA without her or you are going to wait in Japan longer.
