Sent AOS about a month ago, NO word

We sent our AOS over a month ago, and haven't heard anything back... I just noticed on VJ that people sent a check! We didn't send any money... Could this be the reason? If so, Can we send a check somehow?

The USCIS doesn't do anything for free. This is rule no. 1 of the immigration process. Yes, you needed to send a check with the filing fees. More than likely they will return your package to you. Do not send any money at this time, because they will not match it to your application. you better wait for the package to come back, and then refile with the check.

If you didn't send the $1070 needed to process your application then USCIS are not going to take any action on it. Usually they would send it straight back, but if they haven't done that by now then I would seriously think about re-sending the whole pack again, with the check enclosed this time and get signature confirmation on them receiving it.

Remember that USCIS processes nothing without being paid first.

We laugh about it now, but we did the same thing when we sent off our K1 packet. We were travelling, and naively thought we could just send the application on it's way and a few months from then, be on our way back to America. Once we actually got to a computer and found this site, we immediately sent off another packet with all of the required documents and payments. We didn't wait for them to return the original application. That one just got sent back to us later while the new one starting processing.

Okay, why? .... Yes send off a new packet, but why did you send a check for $1450. The filing fee to adjust status, form I-485 is $985 plus a biometrics fee of $85 totalling $1070 as I said in my first post. The filing fees for AP and EAD are waived if you file all forms together. The likelyhood is that they will either send your packet back due to the wrong fee, or they will keep a hold of it and RFE you for the correct amount. Either way you will now have to wait to see what they do.

No, they won't be RFE'd. Incorrect fee is immediate rejection.

Okay well you may as well prepare a new packet with the CORRECT fee of $1070 and cancel the current check. PLEASE stop rushing this. If you missed the fee and now wrote the fee wrong it's likely you're missing something or doing something else wrong. Please have a read of the AOS thread in my signature which has the required document list.

And this is from the instructions in the link that I sent you,

"Please note that, if you file Form I-485 to adjust your status as a permanent resident on or after July 30, 2007, no additional fee is required to also file an application for employment authorization on Form I-765 and/or advance parole on Form I-131."

So as Vanessa&Tony have said your petition will be rejected due to the wrong filing fee.

Whats done is done, My advice would be the same as V&T's re-send with the correct fee. And Please do yourself a favour and read their AOS thread. It was invaluable when my wife and I were putting my packet together. I followed it to the letter with only a few minor adjustments to my own situation and received my green card in seven weeks. The information is out there, you just need to do your homework.

When filing with the I-485, the fee for the I-131 and I-765 are waived. The check should have been for $1070.

The US is like, no money no VISA, if you want plenty of delays and RFE's don't follow the instructions. This process is difficult at best emotionally, more if you cannot follow directions.

Sorry that your first petition was delayed and now you delayed your second petition too.

People seriously need to read the instructions, you have no fee for I-765. The check was to be $1070 ONLY.

Cancel the check and send ANOTHER petition to them or wait to get this petition back and send it with the correct fee.

As stated by others, the EAD fee is waived when filed with AOS (as is the fee for AP). Unfortunately this is the second time you've made a mistake when reading the instructions would have prevented it (seriously VERY clear in the instructions). I suggest you cancel the check. Wait for the petition to be returned and in the meantime READ the instructions, and also read the AOS thread in my signature.
