Hello everyone and thanx in advance for the help.

I am spanish citizen and engage with a beautiful us citizen. We are in the process of obtaining our K1. I already have obtained my criminal records in Spain. However, when I was sixteen years of age I spent 10 months living in the United States as a foreign exchange student (when i first met the girl who at present is my fiancée). The question is weather I will o won't need my 'criminal records check'from the Police Department in the area that i spent those 10 months in 1999. And, if i end up needing them, how am i suppose to obtain them from Spain (country where i am residing now a days)

Aww....that is so sweet the way you met!

And to answer your question - you wont need a Police Certificate to cover any time spent in the US...they have the ability to check that out for themselves.

2 May 2011 - Called NVC and got Invoice ID number

4 May 2011 - Received email reply from NVC for DS-3032; Received Medical Exam results

5 May 2011 - AOS invoiced and paid

7 May 2011 - AOS package sent; IV invoiced and paid

9 May 2011 - AOS package delivered to NVC according to tracking

20 May 2011 - RFE for missing IV package....still waiting on Police Certificate!

24 May 2011 - Received Police Certificate after 25 days (so much for 7-10!); IV package sent

27 May 2011 - IV package delivered according to tracking

8 Jun 2011 - RFE for original marriage certificate; requested supervisor review since we KNOW it was in the package!

30 Jun 2011 - SIF and CC - FINALLY!!!!

13 Jul 2011 - Interview date assigned! Scheduled for August 9th @ 10am

9 Aug 2011 - Interview - APPROVED!!!!!!!!!!!!!!!!!!!!!!!!!

12 Aug 2011 - Visa in hand

Did u get arrested in the states when here??

Even if u did not.

Think you will still need the USA police. Clearance

But sure others will correct me if wrong.

But it's easy to get and better safe then sorry.

Thanx KL for your kind words and for the response.

Now that you explained it so well does obviously make much sense that they only need criminal records from countries other than their own (what was i thinking)

I was just about to apply for a U.S. clearance myself: http://ag.ca.gov/fingerprints/visaimmigration.php. Thru this website. Are you sure it's not necessary because in the paperwork I just received from the Consulate it says police clearances from ANY country you lived for over 12 months. (So 10 months is fine.. you don't need it anyhow!) I lived in the U.S. for 19 months myself. So I thought I would need it. It does not say except the U.S.

Are you guys really sure? I might just get it anyway, like you said better to be safe then sorry!

Police certificates

Police certificates are required for each visa applicant aged 16 years or older. The table below shows how many police certificates are required based on where each applicant lives and has lived previously. Present and former residents of the United States should not obtain any police certificates covering their residence in the U.S.

There have been numerous other threads about this stating that US police clearance is not required...at least not for K1 or CR-1/IR-1 visas..... roseannevh - what visa are you applying for??

Does anyone know if this also covers US territories?

I can't find a definitive answer to this....but I wouldn't think so.

Only thing I can suggest is to maybe email or call the Embassy and ask them.

What I meant was I wouldn't think you would need a police certificate for US territories.
