Ok so heres the facts surrounding me our case and the co sponsors situation

1. Our case was expedited due to my emergency op and loss of job creating financial hardship as i have 2 small children

2. The co sponsor is my dad, 48, in 2009 my hubby donated a kidney to him saving his life. in 2009 my dad worked for walmart right through until February 2011, he only filed tax for 2010 year as previous years he was on SSI and wasnt working. he now currently as we moved back to Texas has been with the same job since February an makes well over the 125% poverty line, his last SSI payment was the first of this month but we dont no if thats included in earnings so we are going by his wages alone as to how much he makes at his new job to be the sponsor

3. we lived together in 2010 ( me and my dad) i didnt work so he claimed my children as was head of household, i have my tax returns for 2008 & 2009 however they dont meet, the earnings for that year should i say, above the poverty line.

4. Regarding my husbands job prospects etc he is a college grad an has worked as a bar manager since returning to the UK in April.

Now my fear is they will decline my dad as the co sponsor for several reasons such as not been working long enough (nearly 2 years). Length of time at new job.

Can anyone give me any peace of mind for my situation :S

Often I hear a general rule of thumb that CO's look for is 6 months at least in current job, however even if you have more they can sometimes request another sponsor. I would say you'll be fine if he has documented income for the last 6 months, and filed his tax return etc correctly, as long as his income can support the total no of dependents etc he has. Did you say you and your hubby and family will be living with him after you get your VISA?

Total time from posting I-130 to VISA in hand 7 months 21 days :D

make sure he has a letter stating the reason why he wasnt required to file then. I know only the most recent years is asked for, but if they do ask for the past 3, you'll need to show a letter showing exactly why he didnt have to file i.e sickness.

In addition to supplying your dads current jobs pay stubs, make sure to also get a note from his employer, stating his position and estimated yearly salary.
