congrats everyone who got their noa2s today

my case..

a)should be a ctz by this sept n then file a K3 for my wife

b)but, due to my bad luck or timing, my oath date is moved from sept to dec :blush: (am not sure untill i see that oath ceremony letter)

so in this mean time want to file a tourist visa for her - 99% rejections ( the embassy she attends will reject saying POTENTIAL IMMIGRANT, happened to may others within the same age group) and 1% approval (simple reason-our luck :whistle: )

now my que 1) suppose, for suppose, she gets a tourist visa (GOD plllllzzzzz let it be a +ve :blink: ) , will this effect our K3 filing

she comes here as a tourist, maybe by dec 06/jan 07 i get my ctz cert and i file our K3, can she go back to India when the noa2 is recieved and finish off that pkt 3 & pkt 4 process ???

que 2) if by bad luck again, she is rejected on the tourist visa, will it be a pain on the K3 :diablo:

plzz all seniors and anyone who has done the above, spouse here in US on tourist visa, while awaiting K3 process, help me (F)

note: if this kinda issue had been answered earlier, am sorry, am already tensed up hearing my ctz news today

Sorry to hear about your oath being delayed. You should speak to your local office and request an earlier oath.

For K3 she must be interviewed in India. If your I-130 is approved before her visa expires, you can do Adjustment of status. Have you filed I-130 yet? You must first file I-130 before you can file I-129F for K3. If you haven't filed I-130 yet, do it right away!!!!!!!!! Good Luck!!!!!!!!!!!!

yea, i did. they said they cant help, but me to wait for the oath letter

how can a greencard, file a i-130 ? it takes forever !!! right ?

for me to do a i-130 and a i-129f, one must be a US ctzn !!! :unsure:

Timeline

You can file your I-130 as a permanent resident, then upgrade the petition when you become a citizen.

You can't file the 1-129F until you are a citizen - but you need the NOA1 from the I-130 to file for the I-129F --- so if you've already filed, it might give you a 2-4 week shortening in time on the K3 b/c you can file on the day you become a citizen rather than waiting to get the I-130 NOA1 after your oath ceremony.
