File K-3 while spouse is outside his country of citizenship?

Hi, I am a new member and this is my first time posting. I'm hoping to find some answers about my situation.

My husband and I have been living in his country of citizenship (Egypt) and we plan to move to America in the future. However, he is a doctor starting his internship/residency period. He was selected for a european training exchange program through his university.. This means we'll be in Europe for for at least a year. The US embassy in Egypt told me that they do not allow US citizens to petition a spouse while overseas, so that would mean I need to go back to the USA for a while to start the paperwork.

But, my question is, can I file for the K-3/I-130 while HE is living/working in Europe? Or must he return to Egypt for this? If he establishes residency in Europe in the meantime, will it make a difference?

Sorry, but I don't have any specifics on which European country we will go to yet until October.

You do not need to return to the USA to file the petition. You can file it by mail to the PO Box address in Chicago. He can interview for the visa in either his country of citizenship or country of residence.

Start by clicking on the word Guides at the top of any page here.

Forget K3. CR1 is the currently available spouse visa. (Or IR1 if you've been married over two years.)

This is the response I received from the department of state.

"Dear Madam,

Thank you for your e-mail message.

Please note that U.S. citizens are no longer able to file immigrant visa

petitions on behalf o immediate family members at any overseas post.

All U.S. citizens must file I-130 petitions with the U.S. Citizenship

and Immigration Services (USCIS) in the U.S.

So, I'm confused, have people been able to do the CR-1 from overseas? So will we need to establish residency in Europe before I file the paperwork?

You file "with the USCIS in the USA" by mail. Go back and read my first post and then the GUIDE.

We've also begun the process since I'm a US citizen living overseas with my husband.

Besides wanting to bash my head in and should've done the paperwork a couple months to file here (takes only 2 months), we waited (had family emergencies) and now have to apply to the lockbox in the US.

If you read this page: http://stockholm.usembassy.gov/petitions.html You can still be abroad and file, you just file to the Lockbox.

What that means in the long run for time it takes, etc is anyone's guess.
