Maybe he wasn't formally arrested. Instead, maybe he was simply detained until he greased their palms.

I don't know anything about Peru, but I heard stories about "arrests" when I lived in Mexico. If you paid the "mordida," you would discover that you were not under arrest after all. :o:whistle:

Just saying...

And I was speaking on these same terms. "Arrest" in USA can be sooooo different than other countries. It's as if the question is: "Have you ever consumed beef?" And you could answer, in a patty form? In a steak form? In a meatball form? So many forms to something in the states seems very black and white, yet elsewhere it's far from that. I'd advise to see what the police report says and go from there...

And before I get banned from the topic :whistle:

I'm not saying do anything illegal! I'm suggesting it's discovered what is on the actual file, figure out the 'real' arrests, ones that actually have been documented and not just crooked police men or whatever and go from there!:dance:

Uhhh...I don't think so.

From somewhere I read, is yes the USCIS does background checks on applicants from the FBI and from Interpol. Currently there are 188 member countries for Interpol. I know I read this somewhere and will try to find the link. It may not be true but being we are trying to protect our borders, it only makes sense.....

Part of the process is that the beneficiary must produce a police report. Either it will state that he was arrested and the disposition of the charges or there will be no record and the document will state that. Have him go to the police station where all this took place and ask for the report. I doubt if the US is going to check every police record in his country so what he produces is what they will go by. However telling the truth is always best. Usually small criminal charges of drug possession will not prevent approval. Moving a few kilos of heroin is quite different.Lets be honest here, the USCIS does not look favorable on "criminals" entering the country so it is up to you to prove that any charges were insignificant to warrant denial.

This thread is about the beneficiary, not the petitioner. I'm sure you remember the NBI report your fiancée was required to submit at her Embassy interview. The USCIS had nothing to do with that.

@OP...I don't know about the U.S. Embassy in Peru, but at the U.S. Embassy Manila a record of drug arrests or admitted illegal drug use will prevent the beneficiary from getting a visa.
